2.40.010 - Environmental matters.¶
(a) Negative Declaration. A public hearing on a Negative Declaration shall be conducted by the planning commission and/or the city council, should the planning director determine that the public interest is served. A public hearing shall be conducted by the city council when it has discretionary review and is authorized to make the final decision on a project. Such a public hearing shall be deemed a public hearing required by law as provided in Public Resources Code Section 21168.
(b) Draft Environmental Impact Report.
(1) A public hearing shall be conducted by the planning commission or the city council to review all draft EIR's (environmental impact reports). A public hearing shall be conducted to make the final decision on a project.
(2) Such public hearings shall be scheduled at least thirty (30) days after the date on which copies of the draft EIR were distributed for public comment.
(3) All hearings shall be deemed public hearings required by law as provided in Public Resources Code Section 21168.
