2.12.010 - Police department—Personnel.

The police department of the city shall be manned by and shall consist of the chief of police, one captain of police, one lieutenant of police, one sergeant of police, and such additional officers or patrolmen as the council determines or confirms from time to time by resolution or ordinance.

2.12.020 - Police department—Compensation.

The captain of police, lieutenant of police, sergeant of police and all other officers or patrolmen shall severally receive as compensation for their respective services, such salaries as the city council may determine from time to time by resolution. In the event of the employment of special officers and clerks in addition to those hereinabove provided for, the special officers and clerks shall be paid such sum as may be fixed by the council by resolution.

2.12.030 - Police department—Hours of work.

All members of the department shall work forty (40) hours per week, at such times and hours as may be prescribed by their superior officers. All officers shall be subject to call twenty-four (24) hours in each day whenever their superior officers shall deem their services necessary for emergencies or otherwise.

2.12.040 - Police department—Supervision—Duties.

No officer of the police department, except the chief of police, shall be subject to the orders of the mayor or city council, except that the mayor shall have such powers as are conferred upon him by the city Charter, and except further that the city council may, by resolution or ordinance, prescribe general changes in the method of conducting the police department, may limit or fix the number of officers on each shift and prescribe their duties. It is the intention of this section to prohibit day-to-day assignments of work by the mayor or councilmen or single-instance interference with the duties of police officers, but to leave day-to-day supervision and direction in the hands of the chief of police, to leave the mayor his supervisory authority and to preserve to the council the right to establish general or uniform rules for the conduct of the department. Each officer of the department of police shall perform such duties as are assigned to him from time to time by the chief of police and other superior officers.

2.12.041 - Police training—State aid.

The city declares that it desires to qualify to receive aid from the state under the provisions of Section 13522, Chapter 1 of Title 4, Part 4 of the California Penal Code.

2.12.042 - Police training—State standards met.

(a) Pursuant to California Penal Code Sections 13522 and 13510 of said Chapter 1, the City of San Rafael, while receiving aid from the State of California pursuant to said Chapter 1, will adhere to the standards for recruitment and training established by the California Commission on Peace Officers Standards and Training.

(b) Pursuant to Section 13512, Chapter 1, the Commission and its representatives may make such inquiries as deemed appropriate by the Commission to ascertain that the city police department's personnel adhere to standards for selection and training established by the Commission on Peace Officer Standards and Training.

2.12.050 - Auxiliary police force— Establishment.

An auxiliary police force is hereby established to be a volunteer organization composed of not to exceed one hundred members. This force shall be a part of the police department of the city of San Rafael and shall be in addition to the regular staff or force of the department.

2.12.060 - Auxiliary police force—Control of.

The chief of police shall have complete authority, control and command, subject to the provisions of this chapter, over the auxiliary police force. He may provide for the training of candidates for membership, and for the further training of members.

2.12.070 - Auxiliary police force—Method of appointment.

No person shall be deemed a member of the auxiliary police force until he has been registered as such in a roster to be kept by the chief of police and not until he has taken his oath that he will observe and obey the Constitution of the United States, the Constitution of this state, and the laws of this nation, this state and this city and that he will carry out the duties of a member of the auxiliary police force of this city to the best of his ability. Members may be nominated by the chief of police or by the mayor, but shall not be deemed qualified and active members of such auxiliary force until confirmed or approved by the council.

2.12.080 - Auxiliary police force— Identification.

An identification card and such other insignia or evidence of identity as may be prescribed by the chief of police shall be issued to each member, who must carry the card and other identification at all times while on duty, and he must surrender them upon the termination of his membership.

2.12.090 - Auxiliary police force—Removal or resignation.

The membership of any person may be terminated by the chief of police at any time, and any member may resign from the auxiliary police force at any time, but it shall be his duty to notify the chief of his resignation.

2.12.100 - Auxiliary police force—Carrying of firearms.

No member of the auxiliary police force shall, while on duty, carry or use any firearm except upon the completion of a course of instructions in the use of the same and having thereafter obtained a certificate signed by the chief of police and countersigned by the officer in charge of training said auxiliary policemen.

2.12.110 - Auxiliary police force—False personation.

It is unlawful for any person to wear, carry or display an auxiliary police force identification card or insignia or otherwise deceitfully represent himself to be connected with such force unless he is in fact a member thereof.

2.12.120 - Auxiliary police force— Compensation.

Members of the auxiliary police force may be compensated in such amounts for any services rendered as authorized from time to time by the chief of police and approved by the city council. This section shall be retroactive to November 1, 1972.

2.12.130 - Auxiliary fire force—Establishment.

An auxiliary fire force is hereby established, to be a voluntary organization, composed of not to exceed one hundred members. This force shall be a part of the fire department of the city and shall be in addition to the regular staff or force of the department.

2.12.200 - Health department—Delegation of authority to county health department.

It is found and determined by the city council that the public interest, health, safety and welfare of the residents of the city require that the Marin County health department be designated as the enforcement agency of and within said city and as such enforcement agency it is authorized and charged with the observation and enforcement of the provisions, laws, rules, sanitary, health and safety provisions, requirements and laws contained in or provided for by the Health and Safety Code of the state as the same now exists or as the same may hereafter be amended, and said Marin County health department is vested, for the purpose of enforcing the provisions of said Health and Safety Code within said city, with all of the jurisdiction and powers vested in or available to said health department by said health and safety code.

2.12.210 - Health department—Reservation of authority to city.

There is reserved to the city the matter of its own health, sanitation and other ordinances, together with and including the matter of controlling and regulating the collection and disposal of garbage, which matters are not intended to be surrendered or delegated to said Marin County health department.

2.12.220 - General office hours.

Except as may otherwise be provided by resolution of the city council, all public offices and departments of the city, save and except the police department, fire department, street department, and public library, shall be kept and remain open for the transaction of business as follows: from Monday to Friday, inclusive, of each week, from eight thirty a.m. (8:30 a.m.) to five p.m. (5:00 p.m.), save and except legal holidays and the day following Thanksgiving. For the purpose of this section, Columbus Day (October 12) shall not be considered a legal holiday.

Except as herein otherwise provided and except as otherwise provided by the Charter of the city and the Constitution and laws of the state, it is provided that every Saturday is a holiday as respects the transaction of business in the public offices and departments of the city, provided, however, that the foregoing provision shall not extend to or affect the following offices and departments of said city or the transaction of business therein or thereby: the police department, the fire department and the public library.

2.12.230 - Police and fire department hours.

The chief of police and the chief of the fire department shall keep their respective offices and departments open, continuously, for the transaction of business.

2.12.240 - Street department hours.

The street department of said city shall be and remain open for the transaction of business, and the business thereof shall be carried on during the periods of time as follows: from Monday to Friday, inclusive, of each week from eight a.m. (8:00 a.m.) to five p.m. (5:00 p.m.), save and except legal holidays.

2.12.250 - Public library hours.

The public library of the city shall be and remain open for the transaction of business, and the business thereof shall be carried on, during the times now established therefor.

2.12.260 - Department of public works—Created—Duties.

There is hereby established for the city of San Rafael, county of Marin, state of California, a department of public works, which shall plan, design, construct, maintain and improve, or supervise the construction, maintenance and improvement of all city streets, sewers and other public works of every kind and nature, including the supervision, inspection and approval of work performed by others and intended to be offered to the city, by dedication for public use, and including also the procurement of rights-of-way for public use. The department shall also assume control and jurisdiction of all functions and duties which by statute, ordinance, usage or public law, are vested in the city engineer, and the office of the city engineer shall be and become an integral part of the department of public works.

2.12.270 - Department of public works—Personnel.

The department of public works shall consist of a supervisor of public works, the city engineer, and such assistants, inspectors and other subordinate employees as the city council may from time to time authorize.

2.12.280 - Supervisor of public works.

There shall be a supervisor of public works who shall have charge of the administration of the department of public works.

2.12.290 - Supervisor of public works—Duties.

Subject to determination of policy by the city council, the supervisor of public works shall have the following powers and perform the following duties:

(a) Supervise and administer all of the functions and duties of the department of public works and the employees thereof, including the making of recommendations to the city council with relation to the employees, the amount of their compensation, and the nature of their duties;

(b) Act as technical adviser and consultant to the city council and to the various department heads of the city government with relation to public works;

(c) Be responsible for the maintenance of adequate records and maps pertaining to public works;

(d) Formulate and from time to time submit to the city council a long-range program for the construction and maintenance of public improvements;

(e) Perform the duties of city traffic engineer;

(f) Perform the duties of city superintendent of streets;

(g) Prepare and deliver to the city manager for submission to the city council, an annual budget for the operation of the department of public works;

(h) Prepare and submit to the city council from time to time and as required, estimates of costs for specific public works projects;

(i) Such other duties as the city manager or city council directs.

2.12.300 - Supervisor of public works—Qualifications.

No person shall be eligible for appointment as supervisor of public works who does not possess an adequate knowledge of municipal public works planning and designing, principles and practices of civil engineering, the planning and coordination of the work of engineering and of technical personnel engaged in office and field work, the ability to review plans and designs and the preparation of cost estimates, the ability to direct and supervise the making of surveys, designs, estimates, legal descriptions, contract documents and inspections, and the ability to maintain effective working relationships with other officers and the public.
