25.16.010 Airport parking facilities. ¶
A. Airport parking facilities are those areas of San José International Airport primarily used for the parking of vehicles and include parking lots, garages, or structures.
B. The boundaries of airport parking facilities shall be as set forth and described in the Airport Master Plan.

25.16.020 Airport parking facilities - Restrictions. ¶
The director is hereby authorized:
A. To designate the airport parking facilities which are made available without charge for the exclusive use of authorized vehicles in accordance with Section 25.16.050 below.
B. To designate portions of the airport parking facilities which are made available for a fee for the exclusive use of vehicles of:
Airline passengers and members of the public visiting the airport;
Airport tenants, licensees, permittees and their employees (including, but not limited to, rental car companies leasing airport land and improvements); and
Disabled persons, bicyclists, and motorcyclists.
C. To designate any portions of the airport parking facilities for the mixed use of vehicles for which payment of parking fees is required, or which may be parked without charge as provided below.
D. To designate a parking time limit on any portion of the airport parking facilities.
E. To designate any portion of the airport parking facilities as a passenger loading zone or a freight loading zone, or as a commercial parking area for the purposes of loading or unloading of passengers and cargo.
F. To designate any portion of the airport parking facilities as a "no stopping, standing or parking" area.
G. To designate where and how vehicles shall be parked by means of parking space markers.
H. To designate direction of travel.

25.16.030 Parking prohibitions. ¶
A. No person shall:
Park or drive any vehicle in any portion of the airport parking facilities which is reserved for a specific use as provided in Section 25.16.020, unless so authorized by the director;
Park any vehicle in any portion of the airport parking facilities which is designated as a parking time limit area for a period of time longer than indicated by posted signs or markings;
Park any vehicle outside the boundaries of a marked parking space;
Park any vehicle in any designated loading zone except to load or unload passengers, cargo or baggage;
Drive any vehicle contrary to the designated direction of travel;
Park any vehicle other than as indicated by posted signs;
Park any vehicle in any portion of the airport parking facilities longer than thirty consecutive days without the prior approval of the director;
Operate any vehicle in the airport parking facilities at speeds greater than the posted speed limits.
Park any vehicle in any area of the airport parking facilities which, at any time, is restricted or prohibited pursuant to federal law or regulations, including but not limited to any order or directive from the Federal Aviation Administration, the

Transportation Security Agency, or any other successor agency or agencies of the United States Government.
B. The director shall, by appropriate markings and/or signs, post all areas of the airport parking facilities which are reserved or otherwise restricted as specified in this section.
C. In the event that a vehicle is parked in violation of this section, any regularly employed and salaried city peace officer, as defined in Chapter 4.5 (commencing with Section 830) of Title 3 of Part 2 of the Penal Code, or any regularly employed and salaried employee of the city, who is engaged in directing traffic or enforcing parking laws and regulations, may remove such vehicle from the airport parking facilities in the manner and subject to the requirements of the California Vehicle Code.

25.16.040 Airport parking facilities - Fees. ¶
No person shall park in any airport parking facility without paying the parking fees as established by resolution of the city council, except as specifically provided in Section 25.16.050 below. (Ord. 25530.)
25.16.050 Parking without charge. ¶
A. Parking without charge shall be authorized by the director only in accordance with this section.
B. The director may authorize parking without charge by:
Issuance of parking permits for reserved airport parking facilities; or
Issuance of parking control cards or other electronic devices for access to airport parking facilities; or
Validation of parking tickets; or
Authorizing a vehicle to exit without charge under the circumstances set forth in Subsection E. below.
C. Parking without charge shall be authorized by the director for the following persons:
Elected representatives of Santa Clara County who are members of the United States Congress, California State Assembly or State Senate, or County Board of Supervisors, if such elected representatives request to park without charge while on official governmental business.
Members of the city council and the airport commission, city council appointees, city officers and employees assigned to the airport, and such other city employees as may be authorized by the city manager, while on official city business.
Officers and employees of the Federal Aviation Administration, United States Customs, Naturalization and Immigration Services, or other federal agencies while conducting official business at the airport.
Management employees of airport tenants or airport contractors while performing work for an airport tenant at the airport.
Contractors and public utility companies while performing work at the airport for the city or for a governmental agency or a business.
Volunteer staff or non-profit organizations which provide information and assistance at the airport to members of the traveling public pursuant to agreements with the city, while on the airport in order to provide such assistance.
Operators of commercial ground transportation vehicles with valid permits for use of airport roadways pursuant to Chapter 25.08, but only for such limited period of time as may be specified in the resolution establishing parking fees adopted by the city council.
Visitors to the airport for the purpose of conducting business with the city or attending ceremonial events or public meetings held at the airport.

D. The director shall maintain appropriate records of all persons who are authorized to park without charge in accordance with this section.
- The director shall not authorize parking without charge in any parking facility for which a fee is charged to the general public, unless such use of an airport parking facility is for an airport-related activity or event, or unless otherwise authorized under Subsection C. above.
- Elected local and state officials, who request to park without charge while on official governmental business pursuant to Section 25.16.050C.1., shall be notified by the director that acceptance of free parking at the airport may disqualify such representatives from taking official action on airport-related matters in the conducting of official duties pursuant to state law. Written authorization issued for such parking shall clearly state that it is only intended for use while on official governmental business.
E. The director may authorize vehicles to exit the parking facilities without charge under the following circumstances:
To relieve traffic congestion in the parking facilities in order to maintain waiting times and levels of service at reasonable levels;
To relieve curbside and roadway congestion next to airport terminals by authorizing vehicles to enter and exit the parking facilities to load and unload passengers and luggage;
To authorize a vehicle to exit one lot in order to find available parking in another airport parking facility; or
When a determination is made that exiting without charge is warranted due to damage or injury to an airport patron's person or property while on the airport or that emergency circumstances at the airport warrant exiting without charge.
