25.01.020 San José International Airport. ¶
The San José International Airport herein referred to as "airport" consists of all that territory containing the runway and taxiway system, passenger terminal facilities, and operational areas of the airport, and generally bounded by the following designated streets and highways (as such streets and highways may be subsequently redesignated): U.S. Route 101, Guadalupe Parkway (Highway 87), Interstate Route 880, Coleman Avenue, Martin Avenue, and De La Cruz Boulevard, in the cities of San José and Santa Clara. 25.01.300 Definitions. ¶
The definitions set forth in this part shall govern the application and interpretation of this title. (Ord. 25529.)
25.01.305 Airport access permit. ¶
"Airport access permit" means a permit that authorizes a taxicab driver to pick up on-demand passengers at the airport. (Ord. 29150.)
25.01.306 Aircraft movement area. ¶
"Aircraft movement area" means the runways, taxiways, and other areas of the airport which are utilized for taxiing/hover taxiing, air taxiing, takeoff, and landing of aircraft, exclusive of loading ramps and parking areas. Specific approval for entry onto the movement area must be obtained from the control tower.

25.01.307 Airport operations area. ¶
"Airport operations area," or "AOA," means a portion of the airport, specified in the airport secu-

rity program, in which security measures specified in this part are carried out. This area includes aircraft movement areas, aircraft parking areas, loading ramps, and safety areas, for use by aircraft regulated under 49 CFR part 1544 or 1546, and any adjacent areas (such as general aviation areas) that are not separated by adequate security systems, measures, or procedures. This area does not include the secured area.

25.01.308 Approved methodology. ¶
"Approved methodology" means the methodology for adjusting airport access contracts, as approved by the San José city council on November 16, 2004, and any amendments subsequently approved by the city council.

25.01.310 Certificated air carrier. ¶
"Certificated air carrier" means any person who undertakes directly by lease or other arrangement to engage in scheduled air transportation of passengers or cargo with an air carrier operating certificate issued by the Federal Aviation Administration.

25.01.320 Commercial activity. ¶
"Commercial activity" means any use of the airport, by any person, which is directly or indirectly related to or connected with air trade, air traffic, or air transportation, and which involves the exchange or provision of goods or services to airport users and/or the general public. (Ord. 25529.)
25.01.325 Common use transportation system. ¶
"Common use transportation system" means a system established by city for transportation of passengers between the terminals and to the consolidated rental car facility. (Ord. 26063.)
25.01.330 Control tower. ¶
"Control tower" means the air traffic control facility located at the airport and operated by the Federal Aviation Administration. (Ord. 25529.)
25.01.340 Courier operator. ¶
A. "Courier operator" means any person using the airport to transport property, baggage, or parcels for business purposes and not for use or consumption on airport property.
B. "Courier operator" does not include any person only transporting property, baggage, or parcels incidental to transporting airport passengers, nor does it include any governmental entity which provides ground transportation service at the airport.

25.01.350 Director. ¶
"Director" means the director of aviation. (Ord. 25529.)
25.01.360 Ground transportation provider. ¶
"Ground transportation provider" means any person providing ground transportation services to and/or from the airport by taxi, limousine, charter party carrier, van, shuttle or bus or other ground transportation common carrier to the general public or shuttle services for airline employees and courtesy transportation provided for business purposes. It also includes courier operators. (Ord. 25529.)
25.01.365 Consolidated rental car facility. ¶
"Consolidated rental car facility" means the consolidated rental car facility and all related improvements constructed jointly for interim use by all. On-airport car rental agencies for on-airport car rental agency commercial activity, or the permanent on-airport consolidated rental car garage constructed by city, as applicable. (Ord. 26063.)
25.01.370 Licenses. ¶
"License" means a license for the use of real property at the airport in conjunction with the

conducting of aviation activity at the airport. Such licenses are contracts issued by the city in its proprietary capacity and are not issued by the city in its regulatory capacity. (Ord. 25529.)
25.01.380 Off-airport car rental agency. ¶
"Off-airport car rental agency" means a person who engages in rental car commercial activity at the airport, without occupying or leasing premises within the airport boundaries, consisting of delivering rental cars to a customer at the airport and/or providing transportation to a customer at the airport for delivery of rental car services at a location outside the airport boundaries. 25.01.390 On-airport car rental agency. ¶
"On-airport car rental agency" means a person who is authorized to occupy or lease premises on the airport for the purposes of rendering rental car services to the general public and airport users pursuant to an agreement for such use with the city. (Ord. 25529.)
25.01.400 On-demand passengers. ¶
"On-demand passengers" means ground transportation passengers who have not requested or made reservation with a specific provider of such services.

25.01.410 Prearranged passengers. ¶
"Prearranged passengers" means passengers who are provided commercial ground transportation for hire to or from the airport, where such transportation was contracted or arranged for, by or on behalf of the passenger in advance of the passenger's arrival at the airport, or after the passenger's arrival at the airport by communicating with a ground transportation provider whose place of business is off the airport. 25.01.411 Restricted area. ¶
"Restricted area" includes both the Airport Operations Area (AOA) and the Security Identification Display Area (SIDA), and any other areas of the airport that requires a valid badge to gain access.

25.01.412 Security identification display area. ¶
"Security identification display area" or "SIDA" means a portion of the Airport Operations Area (AOA) in which security measures are carried out and individual and vehicular identification must be displayed at all times.

25.01.413 Sterile area ¶
"Sterile area" means the area in the terminal beyond the security screening checkpoint(s). (Ord. 30323.)
25.01.420 Waybill. ¶
A. "Waybill" for courier operators means a document containing the courier customer's name, the time of arrival at the authorized courier location and the airline on which the property, parcel or baggage to be picked up will arrive or to which the items are to be delivered by the courier operator.
B. "Waybill" for all ground transportation providers except courier operators, means a document containing the passenger's name(s), the number of persons in the party, the location of the pickup, and the airline and flight number on which the passenger arrived or will arrive.
