5-2400 - ACCUMULATION OF REFUSE, WASTE AND FILTH PROHIBITED.¶
No owner, lessee, agent, or occupant of a lot or parcel of land upon which a building of any kind may exist, or of a vacant lot or parcel of land, shall allow any collection of refuse or waste matter of any kind or description to accumulate or to remain on such lot or parcel for longer than seven (7) days except as provided in Sections 5-2300, 5-2301, and 5-2607 or except as provided in any rules and regulations adopted pursuant to this division.

5-2401 - DISPOSAL ON PREMISES.¶
In the event that refuse is disposed of on the premises of an industrial or commercial establishment pursuant to Section 5-2300, or upon the premises of a farm or single-family residence pursuant to Section 5-2301, such disposal shall be strictly pursuant to the rules and regulations prescribed by the Health District.

5-2402 - METALLIC OR PLASTIC CONTAINERS REQUIRED.¶
Any person maintaining any premises within the County where refuse or waste matter of any kind is created, produced, or accumulated upon such premises shall procure a metallic or plastic container or containers with close-fitting covers for receiving and holding, without leakage of liquids or escape of odors, all such refuse or waste matter of any kind which is produced, created, or accumulated upon such premises, and all such persons shall deposit all such refuse or waste matter of any kind in such a container. All such containers shall at all times be kept in a sanitary condition, and good repair, and shall be located in such a place as to be readily accessible for removing and emptying the same, but such containers shall not be placed within the traveled portion of any street, road, or avenue in the County, or anywhere in such manner as to constitute a nuisance. No such container shall be placed in a location so as to require a refuse collector or his agents or employees to be physically endangered by dogs or other animals or by other causes while in the process of removing and emptying such containers. The individual containers shall have a capacity of not greater than thirty-five (35) gallons and shall weigh, when placed for collection, not more than fifty (50) pounds, except where mechanical loading systems are used.

5-2403 - FREQUENCY OF SERVICE.¶
All refuse produced or accumulated in or about any dwelling within the County shall be disposed of or removed from the premises at least once each calendar week. All refuse created, produced, or accumulated at any industrial, commercial, or institutional establishment anywhere in the County shall be disposed of or removed from the premises at least twice in each calendar week.
The Health District, after investigation and upon adequate and reasonable justification, may vary the requirements of this section. Such variances shall be subject to appeal to the Board. Such variances shall be adopted and shall be subject to appeal in the same manner as rules and regulations adopted by the Health District pursuant to this division.

5-2404 - MANDATORY RESIDENTIAL SOLID WASTE COLLECTION.¶
(a) The Board may establish mandatory residential solid waste collection areas by order of the Board. Unless otherwise specified by the Board, all unincorporated real property parcels, with at least one (1) and no more than four (4) habitation units, for which any of the following residential zoning classifications apply, shall be included in mandatory residential solid waste collection areas:

(b) Residential solid waste collection and related services will be provided by the franchise collectors, as required by the residential refuse collection contacts, to residents within mandatory residential solid waste collection areas, whether or not these services were requested by the property owner or tenant. Residential properties are exempt from mandatory residential solid waste collection and related services during periods of vacancy.
(c) Residents within mandatory residential solid waste collection areas shall pay the rates established by the Board for services to be provided in such areas. When charges for such services become delinquent and unpaid for a period of sixty (60) days or more, the County shall notify property owners of such delinquency. Annually, charges which remain delinquent and unpaid for a period of sixty (60) days or more, shall be levied on the respective parcels in accordance with Sections 5-3300 through 5-3306 of the San Joaquin County Ordinance Code.
