5-6100 - APPLICABILITY.¶
This division shall be used to determine the rules, regulations and user fees for sanitary sewer service. This division also establishes discharge requirements for sewage that is treated by the County.
When the wastewater is treated by the City of Stockton Regional Wastewater Treatment Facility, the following provisions of Chapter 7, Part III, of the Stockton Municipal Code shall apply:
All discharges: Division 1, Division 2 and Division 4.
Nonresidential users: Division 3 and Division 5.
The city may bill certain nonresidential users directly for costs associated with permitting, pretreatment or treatment of wastewater discharges.
The County may also impose fees and charges for maintenance of the County collection system or to pass on costs imposed by another agency for treatment of wastewater.

5-6101 - PURPOSE AND POLICY.¶
This division sets uniform requirements for discharges into the wastewater collection and treatment system of County or the City of Stockton and enables the County and the City of Stockton to comply with the administrative provisions of the Clean Water Act, the water quality requirements set by the Regional Water Quality Control Board and the applicable effluent limitations, national standards of performance, toxic and pretreatment effluent standards, and any other discharge criteria which are required or authorized by State or Federal law, and to derive the maximum public benefit by regulating the quality and quantity of wastewater discharged into those systems. This division provides for the setting of user charges and fees for the equitable distribution of costs to all users, the issuance of permits to certain users, authorizes monitoring and enforcement activities, and requires user reporting. Revenues derived from the application of this division may be used to defray the County's share of the City of Stockton's cost of operating and maintaining an adequate wastewater collection and treatment system and to provide sufficient funds for capital outlay, bond service costs, capital improvements and depreciation. The objectives of this division to comply with the Clean Water Act are:
(a) To prevent the introduction of pollutants into the municipal wastewater system which will interfere with the operation of the system or contaminate the resulting sludge;
(b) To prevent the introduction of pollutants into the municipal wastewater system, which will pass through the system, inadequately treated, into receiving waters or the atmosphere or otherwise be incompatible with the system;
(c) To improve the opportunity to recycle and reclaim wastewaters and sludges from the system;
(d) To provide for equitable distribution of the cost of the municipal wastewater system. Except as otherwise provided herein, the Director of Public Works shall administer, implement and enforce the provisions of this division.

5-6102 - REFERENCE TO PLUMBING CODE AND PLUMBING ORDINANCE.¶
All uniform Plumbing Code and plumbing ordinance provisions shall remain in full force and effect, and nothing contained herein shall be construed as to waive any requirements contained therein.

5-6103 - DELEGATION OF POWERS.¶
The Director of Public Works is expressly authorized to delegate administration, implementation and enforcement authority under this division to the Stockton City Director of the Municipal Utility Department for purposes of carrying out the provisions of this Division concerning wastewater discharges into the city wastewater Collection and treatment system in order to establish a coordinated, effective and uniform operation of the wastewater collection and treatment system for Metropolitan Stockton.

5-6104 - COUNTY'S NONLIABILITY.¶
The provisions hereof shall not be construed to relieve from or lessen the responsibility of any person of the damages to life or property in the discharge of industrial wastes nor shall the County, nor any agent thereof, be held assuming any liability by reason of performance of duties hereunder.

5-6105 - DIRECTOR TO ENFORCE.¶
The Director or a designated representative shall enforce the provisions hereof. Such powers shall not limit or otherwise affect the powers and duties of any other County official.

5-6106 - TIME LIMITS.¶
Any time limit provided for herein may be extended by consent of the officer concerned.
