(a) Pursuant to the provisions of state law, the city officers or employees designated by resolution of the city council may issue a citation without a warrant whenever they have reasonable cause to believe that the person to whom the citation is issued has committed an infraction in their presence which is a violation of those sections of the Code designated as such in section 1-10.
(b) Citations for infractions shall be processed, issued and handled as provided by state law.
(c) An officer or employee making an arrest under the authority of this section shall follow the citation release procedures prescribed in Penal Code 853.5 et seq., or such procedures enacted by the state."
Section 6. Nothing contained in this Ordinance is intended to affect the validity of Ordinance Nos. 1498, 1500, 1501, 1502, 1503, 1504, 1505, 1509, 1510, 1511, 1512, 1513, 1515, 1516, 1517 and following, which Ordinances the City Clerk is hereby directed to cause to be incorporated into the San Fernando Municipal Code (2000 Edition). Upon the adoption of any amendment or addition to this Code, or upon the repeal of any of its provisions, the City Clerk shall certify thereto. Duly certified copies of every Ordinance making changes in such code shall be filed in the office of the City Clerk in books for such purpose, duly indexed for ready reference. The City Clerk is directed to incorporate in regular supplements to the San Fernando Municipal Code (2000 Edition) all amendments, additions or deletions adopted by the City Council.
Section 7. The repealing provisions of this Ordinance shall not affect or impair any act done, or right vested or approved, or any proceeding, suit or prosecution which has occurred or commenced in any cause before the repealing provisions of this Ordinance shall take effect; but every such act, vested right, proceeding, suit or prosecution shall remain in full force and effect for all purposes as if the applicable provisions of the 1957 Code had remained in full force and effect. No offense committed and no liability, penalty or forfeiture, either civil or criminal, incurred prior to the repeal or alteration of any applicable provision of the 1957 Code as amended, shall be discharged or affected by such repeal or alteration; but prosecutions and suits for such offenses, liabilities, penalties or forfeitures shall be instituted and proceed in all respects as if the applicable provisions of the 1957 Code, as amended, had not been repealed or altered.
Section 8. The table of contents appearing at the beginning of the 2000 Recodification and at the beginning of each Title thereof are not adopted as a part of this Recodification, but are included for convenience only, and shall be editorially changed from time to time to conform with amendments and additions to this Code.
