Sec. 38-91. - Permit required.¶
No person shall make a public display of fireworks unless a permit is first obtained therefor.

Sec. 38-92. - Permit application generally.¶
Any person planning to make a public display of fireworks shall first make written application for a permit to the chief of the fire department at least ten days in advance of the date of the proposed display.

Sec. 38-93. - Bond and insurance.¶
The applicant for a public fireworks display permit shall, at the time of application, furnish proof that he carries compensation insurance for his employees, which insurance shall be in full force and effect during the time of the display, as provided by state laws, and that he has filed with the city clerk a bond with at least two good and sufficient sureties to be approved by the city council in the sum of not less than $1,000,000.00, combined single limits for each occurrence, with a deductible not to exceed $15,000.00, conditioned upon the applicant's payment of all damages to persons or property which shall or may result from or be caused by such public display of fireworks or any negligence on the part of the applicant or his agents, servants, employees or subcontractors in the presentation thereof; or the applicant shall furnish proof by filing appropriate certificates with the city clerk evidencing the carrying of appropriate public liability insurance, issued by an insurance carrier authorized to transact business in the state, providing minimum coverage covering and insuring the applicant from and against all damages to persons and property in the amounts specified in this section which may result from or be caused by such display. The policies shall be approved by the city council. All certificates of insurance so filed shall provide that the insurance shall not be cancelled except upon 15 days' prior written notice to the city. If a policy is cancelled and the cancellation date is effective prior to the date of the public display, the council may then revoke and suspend the display permit.

Sec. 38-94. - Permit fee.¶
A fee of $100.00 is fixed and established as the sum to be paid for a permit to conduct a public display of fireworks.

Sec. 38-95. - Scope of permit.¶
A permit issued under this division shall have the effect of making lawful the sale, possession and use of fireworks for public display only.

Sec. 38-96. - Investigation of permit application.¶
It shall be the duty of the chief of the fire department to make an investigation and submit a report of his findings and recommendations for or against the issuance of the permit to make a public display of fireworks, together with his reasons therefor, to the city council.

Sec. 38-97. - Issuance or denial of permit.¶
The city council shall have power in its discretion to grant or deny the application to make a public display of fireworks.

Sec. 38-98. - Supervision.¶
Every public display of fireworks shall be handled or supervised by a competent and experienced pyrotechnic operator approved by the chief of the fire department.

Sec. 38-99. - Character, location and discharge.¶
All public displays of fireworks shall be of such character and so located, discharged or fired as not to be hazardous or dangerous to persons or property.

Sec. 38-100. - Rules and regulations of fire chief.¶
The chief of the fire department shall adopt reasonable rules and regulations for the granting of permits for and the presentation of public displays of the fireworks.
