Sec. 38-61. - Definitions.¶
The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
Fireworks means and includes, but is not limited to, the following:
(1) Firecrackers, buzz bombs, sparklers, sky rockets, bottle rockets, Roman candles, torpedoes, M80's, or other fireworks of like construction, and any object containing any combustible or explosive substance designed for the purpose of producing a visible or audible effect by combustion, explosion, deflagration or detonation;
(2) Blank cartridges, toy pistols, toy guns or toy cannons in which explosives are used;
(3) All fireworks which have been classified and registered as "safe and sane" by the state fire marshal; and
(4) All fireworks as the term is used in Health and Safety Code §§ 12505, 12511 and 12529.
The term "fireworks" does not include toy pistols, toy guns, or other similar devices in which paper caps containing not more than 0.25 grain of explosive compound per cap is used.
Public display of fireworks means an entertainment feature where the public or a private group is admitted or permitted to view the display or discharge of fireworks under the permit procedures described in division 2 of this article.

Sec. 38-62. - Possession and sale.¶
It is unlawful for any person to offer for sale, sell at retail, sell at wholesale, manufacture, transport, convey, possess, store, display, dispose of, give away, stock, or own any fireworks at any time within the boundaries of the city, except as specifically permitted in division 2 of this article.

Sec. 38-63. - Discharge.¶
It is unlawful for any person to use, discharge, light, explode, detonate, or otherwise fire or use or to permit the ignition, explosion or detonation of any fireworks within the boundaries of the city, except as specifically permitted in division 2 of this article.

Sec. 38-64. - Exceptions.¶
This division does not prohibit the use of torpedoes, flares or fuses by railroad or other transportation agencies for signal purposes or illumination; the sale or use of blank cartridges for ceremonial purposes, athletic or sporting events, military ceremonials or demonstrations; or, as provided by this article, in connection with a public display as permitted under division 2 of this article.
