Sec. 2-161. - Office established; appointment.

There shall be a city clerk who shall be appointed by the city manager and included in the civil service system pursuant to division 5 of this article.

Sec. 2-162. - Powers and duties.

(a) The city clerk or a duly authorized representative shall:

(1) Attend all regularly scheduled meetings of the council, and others as directed, and be responsible for the recording and maintaining of a full and true record of all of the proceedings of the council in books that shall bear appropriate titles and that shall be devoted to such purpose.

(2) Maintain separate books, in which shall be recorded respectively all ordinances and resolutions, with the certificate of the clerk annexed to each document stating that the document is the original or a correct copy, and with respect to an ordinance stating that the ordinance has been posted or published in accordance with this chapter. The books shall be properly indexed and open to public inspection.

(3) Maintain separate books in which a record shall be made of all written contracts and official bonds.

(4) Be the custodian of the city seal.

(5) Conduct all city elections.

(6) Perform such other duties as may be prescribed by the council.

(b) The city clerk may administer oaths or affirmations, take affidavits and depositions pertaining to the affairs and business of the city, and certify copies of official records.

Sec. 2-163. - Bond.

The city clerk shall, before entering upon the duties of his office, execute and deliver to the city a bond in the penal sum of $25,000.00. Such bond shall conform to the provisions of the state Government Code relating to bonds for such officer.
