SEC. 84.800. SAN DIEGO COUNTY ARTS AND CULTURE COMMISSION.¶
The Board of Supervisors of the County of San Diego declares that it is the policy of the County to promote greater cultural equity, access, and inclusion; to champion the arts as essential to daily life by investing in a vibrant arts community; shape innovative cultural policy; and build public awareness of the value and benefits of the arts and cultural diversity. In order to promote this policy and to provide an open forum for discussion and action, there is hereby established a San Diego County Arts and Culture Commission (Commission).

SEC. 84.801. MEMBERSHIP AND SELECTION.¶
The Commission shall be comprised of thirteen (13) members appointed by the Board of Supervisors. Each member of the Board of Supervisors shall nominate two members for appointment to the Commission. Additionally, there shall be three youth members (age 16-24 at the time of appointment) who shall be nominated by the Chief Administrative Officer. All members shall be residents of the County of San Diego.

SEC. 84.802. APPOINTMENTS.¶
The nominating authority shall: 1) consider nominations made by interested community organizations or residents if submitted at least two weeks prior to appointment, 2) attempt to reflect in Commission appointments comprehensive representation of age, socio-economic status, ethnic background and geographical distribution, 3) consider the prospective members' knowledge and awareness of the problems and rights of the arts community in San Diego County. A record shall be kept of all applications filed for a period of one year.

SEC. 84.803. TERM OF OFFICE.¶
Each Commissioner shall serve a term which shall run concurrently with the term of the member of the Board of Supervisors who nominated that Commissioner. The term shall expire on the date of expiration of the term of the nominating member of the Board of Supervisors, or at such time as they cease to hold office, whichever first occurs. Youth Commissioners nominated by the Chief Administrative Officer shall serve a term of two years. Any Commissioner whose term has expired hereunder shall continue to discharge their duties as a Commissioner until their successor has been appointed and qualified. The reelection of a member of the Board of Supervisors for a succeeding term shall not automatically extend the term of any member of the Commission.
Each member of the Commission shall represent the entire area and population of the County in performing the Commissioner's duties.

SEC. 84.804. VACANCIES.¶
A vacancy shall occur on the happening of any of the following events before the expiration of the term:
(1) The death of the incumbent,
(2) The resignation of the incumbent,
(3) Removal at the pleasure of the appointing or nominating authority,
(4) The ceasing of the incumbent to be a resident of the County of San Diego, or
(5) Unexcused absence from more than one-third of the regular scheduled meetings in any 12-month period or three consecutive meetings. When a vacancy occurs as the result of missing one-third of regular scheduled meetings in one 12- month period or three consecutive regular meetings both the member and the appointing authority shall be notified. Vacancies shall be filled by the appointing authority when a vacancy occurs.

SEC. 84.805. ORGANIZATION.¶
(a) Officers. The Commission shall select annually from its membership a Chair, a Vice-Chairperson, and any other officers it deems necessary.
(b) Bylaws. The Commission shall prepare and adopt the necessary rules and regulations for the conduct of its business. These rules and regulations are to be approved by the Board of Supervisors.
(c) Quorum. A majority of members currently appointed to the Commission shall constitute a quorum. A majority of members in attendance shall be required to carry any motion or proposal.
(d) Minutes. The Commission shall keep written minutes of its meetings, a copy of which shall be filed with the Clerk of the Board of Supervisors.
(e) Meetings. The Commission shall be subject to the Ralph M. Brown Act. The Commission shall establish a regular meeting schedule and shall give public notice of the time and place of meetings. All meetings of the Commission, including any ad hoc committees or other committees appointed by the Commission, shall be open and public and all persons shall be permitted to attend any meetings of the Commission, including any ad hoc committees or other committees appointed by the Commission. The location of Commission meetings, including those of any ad hoc committees or other committees appointed by the Commission, shall be determined with consideration for equal and fair access for persons residing in all areas of the County, and for geographical, social or economic interest in matters to be considered at a particular meeting.

SEC. 84.806. ESTABLISHMENT OF COMMITTEES.¶
Committees. The Commission may appoint committees for the purpose of carrying out the functions and duties of the Commission. Any committee appointed shall consist of not fewer than three members, including at least one Commission member. The actions and recommendations of committees shall not be deemed the action of the Commission and shall in no way bind the Commission or its members. The committee shall cease to exist on completion of its assignment.

SEC. 84.807. COMPENSATION.¶
Members of the Commission shall receive no compensation and not be eligible for reimbursement of expenses.

SEC. 84.808. DUTIES AND RESPONSIBILITIES.¶
The Commission shall have the power and duty to promote and advise in matters impacting arts and culture, including:
(a) Study and evaluate key issues and trends impacting arts and culture in the region.
(b) Promote equity in access to arts and culture in the region.
(c) Communicate and engage with artists, arts and culture organizations, the greater community, and County personnel regarding information related to arts and culture.
(d) Promote policies, funding, access, awareness, and equity to support the growth and vitality of the arts, culture, and creative sector.
(e) Advise the Board of Supervisors and County personnel on policies and programs related to arts and culture.
(f) Conduct public hearings, meetings, and workshops dealing with matters before the Commission.
(g) Advance arts education for people of all ages to increase their appreciation for, understanding of, and participation in arts and culture.

SEC. 84.809. STAFF ASSISTANCE.¶
The Chief Administrative Officer shall appoint the administrative staff of the Commission.

SEC. 84.810. ORDINANCE CHANGES.¶
Any proposed change in the provisions of this Article III of the Administrative Code shall be submitted to the Commission for review and comment prior to said proposed change being considered by the Board of Supervisors.

[HUMAN TRAFFICKING AND COMMERCIAL SEXUAL EXPLOITATION OF CHILDREN ADVISORY COUNCIL]
SEC. 84.900. THE SAN DIEGO REGIONAL HUMAN TRAFFICKING AND¶
COMMERCIAL SEXUAL EXPLOITATION OF CHILDREN ADVISORY COUNCIL.
On June 14, 2011, the Board of Supervisors established the San Diego Regional Human Trafficking and Commercial Sexual Exploitation of Children (CSEC) Advisory Council (Advisory Council).

SEC. 84.901. INTENT AND PURPOSE.¶
The purpose of the Advisory Council is to collaboratively create long-term, systemic changes to effectively address human trafficking and the commercial sexual exploitation of children.
The intent of the Advisory Council is to implement a holistic, countywide approach integrating the "Four P's Model" of the U.S. Department of Justice: Prevention, Protection, Prosecution, and Partnerships. It will focus on identifying best practices, promising trends and collaborative actions to address the root causes of trafficking and exploitation, advance public policy, standardize training and protocols, and enhance victim services through an optimized, seamless service delivery system.

SEC. 84.902. APPLICABILITY.¶
All individuals serving on the Advisory Council as of the effective date of this Article shall continue to serve in their current capacity for the duration of their respective terms, subject to the other provisions of this Article. Upon expiration or vacancy of any such term, a new member will be appointed as described in section 84.905.

SEC. 84.903. DUTIES AND RESPONSIBILITIES.¶
The Advisory Council shall have the following duties and responsibilities:
(a) Provide recommendations to the Board of Supervisors for combating human trafficking in San Diego.
(b) Provide a forum for interagency cooperation on human trafficking related issues.
(c) Promote public awareness of human trafficking and the resources available for intervention.
(d) Encourage and facilitate training of professionals in the prevention, protection from, and prosecution of human trafficking.
(e) Recommend improvements in services to families and victims of human trafficking and those who may be at risk.
(f) Encourage and facilitate community support for human trafficking support programs.
(g) Collaborate and communicate with other advisory boards on issues of mutual concern.

SEC. 84.904. MEMBERSHIP AND SELECTION.¶
The Advisory Council shall consist of twenty (20) voting members as follows:
(a) Two (2) members from the business community.
(b) Two (2) members appointed by the Director of Child and Family Well-Being.
(c) Two (2) members who represent community-based efforts to raise awareness of and prevent trafficking or to advocate for victims of or those at risk of human trafficking.
(d) Two (2) members employed in the education field.
(e) Two (2) members employed in the behavioral health or healthcare field.
(f) Two (2) members employed by a law enforcement or prosecution agency involved in prevention and protection from human trafficking appointed by the San Diego Human Trafficking Task Force (HTTF). In the event the HTTF ceases to exist, the member will be appointed by the Chief Administrative Officer (CAO) or their designated Deputy Chief Administrative Officer (DCAO).
(g) Two (2) members representing a prosecution agency appointed by the San Diego County District Attorney and the San Diego City Attorney.
(h) Two (2) members engaged in formal research and/or data collection in the field of human trafficking.
(i) Two (2) members who are survivors of human trafficking or a family member of a survivor.
(j) Two (2) members working for a community-based entity that provide direct services to survivors of human trafficking.

SEC. 84.905. APPOINTMENT.¶
(a) Except for members appointed by the District Attorney, City Attorney, Director of Child and Family Well-Being, and the Human Trafficking Task Force, the CAO or their designated Deputy will appoint members to the Advisory Council.

SEC. 84.906. TERM OF OFFICE.¶
(a) All members shall serve a term of two (2) years.
(b) Members shall serve for no more than two consecutive terms. A term shall include any appointment to fill a vacancy for one year or more.
(c) Any member whose term has expired shall continue their duties until a successor is appointed.
(d) If a vacancy occurs in mid-term, the new member shall serve for the remainder of the term of the member being replaced.

SEC. 84.907. VACANCIES.¶
A vacancy shall be recognized before the expiration of the term upon the occurrence of any of the following:
(a) The death of the incumbent.
(b) The resignation of the incumbent.
(c) Removal at the pleasure of the appointing authority.
(d) If the incumbent ceases to reside in the County of San Diego.
(e) Unexcused absences from more than half of the regularly scheduled full Advisory Council meetings in any twelve (12) month period.
(f) A vacancy left by a member serving a term will be filled to serve out the remainder of the term.

SEC. 84.909. COMPENSATION AND EXPENSES.¶
Members of the Advisory Council shall serve without compensation and shall not be reimbursed for expenses incurred in performing the duties assigned to them under this Article.
