2.58.010. - City Seal and Logo—Establishment.

The City hereby adopts an official seal and logo, the design and color of which are as set forth below:

2.58.020. - Use of City Seal and City Logo.

A. .....The City seal and the City logo are the property of the City of San Clemente. Both share the same image but are used for different purposes. The seal is used to emboss official City documents and instruments to validate their authenticity and to indicate institutional sanction for official, legal and ceremonial purposes. The logo is a graphic emblem used to identify documents, property, and programs that reflect official City business, ownership, or endorsement, and to identify persons duly elected or appointed to a City position or office.

B. .....The City Clerk or his/her designee shall be the custodian of the official seal for the City.

C. .....The City Manager or his/her designee shall be the custodian of the official logo of the City.

D. .....The City Clerk or his/her designee, acting as the custodian of the official seal of the City, is authorized to use the City seal on any ordinance, resolution, honoraria, certificate, notarial jurat or acknowledgment, or other instrument necessary to authenticate official City documents or to indicate institutional sanction for official, legal and ceremonial purposes.

E. .....The City Manager or his/her designee, acting as the custodian of the official logo of the City, is authorized to determine the appropriate usage of the logo and to ensure that the logo is used only on documents, property, and programs that reflect official City business, ownership, or endorsement, and to identify persons duly elected or appointed to a City position or office. In deciding the manner in which the City's official logo may be utilized, the City Manager shall endeavor to protect the City's brand, reputation and credibility by preventing use of the logo in such a manner as to suggest City endorsement of events, political issues, products and other uses that are not City approved.

F. .....It shall be unlawful for any person, firm, association or corporation to make or use the City seal, the City logo, or any portion, facsimile or reproduction thereof, or make or use any design, symbol, emblem, insignia or similar device that is an imitation of said City seal or City logo, or that may be mistaken therefor, that is designed, intended or likely to confuse, deceive or mislead the public, for private or commercial purposes, or for any purpose other than for the official business of the City without the express written consent of the City Clerk or City Manager or their designees under the authority granted by the City Council.

2.58.030. - Penalty.

Violations of Section 2.58.020 of the Municipal Code shall be subject to the arrest and citation procedure set forth in Chapter 1.12 and criminal and administrative fines pursuant to Chapters 1.16 and 1.20.
