12.16.120 - Authority of Superintendent of Streets.

The Superintendent of Streets is hereby authorized and empowered to regulate the location of any service poles of a public utility company, or the location of any pipes or conduits, in, upon or under any public street, alley or easement.

12.16.130 - Application for excavations in streets, alleys, etc., to be filed with Superintendent of Streets.

Any public utility company operating within the City desiring to make any excavation in, upon or under the service of any public street, alley or easement for the purpose of installing, repairing or removing any pipe or conduit, or for the placement or removal of any service pole supporting transmission wires, shall file an application with the Superintendent of Streets.

12.16.140 - Application for excavations to be accompanied by sketch or plat.

The application referred to in Section 12.16.130 shall be accompanied by a sketch or plat showing the nature of the proposed work and the exact location upon which such work will be performed.

12.16.150 - Issuance of certificate authorizing excavations.

Upon receiving the application referred to in Sections 12.16.130 and 12.16.140, the Superintendent of Streets shall issue a certificate authorizing such work if he or she is satisfied that the location, size and depth of such excavation or location of such poles meet the requirements adopted by the City relating to such work.

12.16.160 - Inspection fees.

Fees for permit and inspection costs as established by resolution of the City Council shall be collected for each permit issued pursuant to the provisions of this chapter.

12.16.170 - Making excavations without certificate prohibited.

No public utility company shall make or cause to be made any excavation in, upon or under the surface of any public street, alley or easement for the purpose of installing, repairing or removing any pipe or conduit, or for the placement or removal of any service pole supporting transmission wires, without first securing a certificate from the Superintendent of Streets authorizing such work.

12.16.180 - Backfilling of excavations.

All excavations made or caused to be made by any public utility company upon any public street, alley or easement under the provisions of this division shall be backfilled as required by Section 54 of Ordinance No. 21 of the City, as amended by Ordinance No. 194 and Ordinance No. 206, or any subsequent amendment thereto, which ordinances are not included in this code.
