§ 3.05.050 ESTABLISHMENT; COMPOSITION; COMPENSATION.¶
(A) There is hereby established a planning commission for San Benito County. The Planning Commission shall consist of five members who shall be appointed by the Board of Supervisors, one for each Supervisorial District. For any appointments after July 1, 2011, the Planning Commissioner shall reside, when appointed and during the term of the appointment, in the supervisorial district of the nominating supervisor. The appointment of each Commissioner shall be recommended by the respective supervisor from that District who shall place the name of his or her candidate in nomination. The appointment must be confirmed by a majority vote of the Board of Supervisors. (B) All present members of the Planning Commission shall be entitled to serve until the end of their respective terms. Thereafter, the term of office of each Commissioner shall be coterminous with that of the duly elected supervisor by whom the Commissioner is nominated for appointment. If a vacancy occurs on the Planning Commission other than by expiration of term, it shall be filled in a manner consistent with this section by appointment for the unexpired portion of the prior Commissioner’s term. (C) The Planning Commission shall elect a chairperson and a vice-chairperson from among its members to serve for a term of one year and may elect other officials and representatives as the Commission deems necessary. (D) The members of the Planning Commission may be compensated in a sum to be fixed by the Board of Supervisors. § 3.05.051 MEETINGS; DUTIES; OPERATION.¶
(A) The Planning Commission shall hold at least one regular meeting each month and it shall adopt rules of procedure for the transaction of business. The Commission shall cause records to be kept of its proceedings, resolutions, transactions, findings and determinations. The records of the Planning Commission shall be available to the public. (B) (1) It shall be the duty of the Planning Commission to make a recommendation to the Board of Supervisors regarding any proposed master or general plan for the physical development of the county. (2) Additionally, the Planning Commission shall perform those planning and zoning duties specified by state law or county ordinance, including, but not limited to, the duties related to legislative matters and the duties related to quasi-judicial matters and appeals thereof. (3) The Planning Commission shall have such further duties and responsibilities as may be assigned to it from time to time by the Board of Supervisors. (4) It may contract for services, subject to the provisions of law, provided that all expenditures of the Commission shall be within amounts appropriated by the Board of Supervisors. It shall serve in an advisory capacity to the Board of Supervisors and shall perform such other functions as the Board of Supervisors may request or provide. (C) The San Benito County Planning Department shall assist and advise the Planning Commission as directed by the Board of Supervisors. The assistance and advice shall include, but not be limited to, the provision of staff and resources to enable the Commission to function, operate and transact such business as may be addressed to the Commission.
