2.20.010 - Established.

There is established within the city the position of city manager.

2.20.020 - References to administrator.

Whenever the words "administrator" or "city administrator" appear in existing ordinances, they shall be deemed to mean and refer to the city manager, and all ordinances not expressly repealed by the ordinance codified in this chapter and not inconsistent with the provisions of this chapter, referring to or respecting the rights, duties, powers and obligations of the administrator, are continued in full force and effect.

2.20.030 - Appointment—Term—Council members restricted.

The council shall appoint the city manager, who shall serve at its pleasure. The council may contract, under such terms and conditions as it may deem reasonable, with any person to fill the position of city manager, except that no person who has served on the council may be appointed city manager within one year of the last day of such service.

2.20.040 - Duties.

The city manager shall perform all of the following duties:

A. Provide day-to-day administration of the affairs of the city, including control over all city departments, programs and personnel and administration of all franchises permits, and privileges granted by the city;

B. Oversee the proper enforcement of all ordinances, rules and regulations;

C. Carry out the programs and policies of the city council;

D. Keep the city council fully advised as to the financial condition and needs of the city;

E. Comprise or settle damage claims against the city after careful investigation up to amounts established by resolution of the council;

F. Investigate all complaints against the city, its departments, officers and employees, and take necessary corrective action, if warranted;

G. Manage and control all real and personal property owned, leased, rented or borrowed by the city;

H. Accept or dispose of, on behalf of the city, real and personal property of a value up to amounts established by resolution of the city council; recommend, on actions beyond city manager, authority to the city council;

I. To execute in the name of the city council and city, any contract, agreement, conveyance, or obligation authorized or approved by the city council, unless the city council shall expressly provide for other manner of execution of such contract, agreement, or obligation, or unless the signature of the council is otherwise required by law; and

J. Perform all other duties and responsibilities as may, from time to time, be prescribed by ordinance, resolution, order or direction of the city council.

2.20.050 - Concurrent offices.

The city manager or his designee shall occupy the following offices:

A. Finance director as specified in Chapter 2.28 of this code;

B. Personnel director, in which capacity he shall be responsible for all matters pertaining to the testing, hiring, promotion and termination of city employees, except for any elected official and the city attorney;

C. Planning director, in which capacity he shall be responsible for all matters pertaining to the execution of all statutes and ordinances pertaining to the development of real property within the city;

D. City engineer (if he is licensed to practice engineering in the state of California), in which capacity he shall be responsible for all engineering and public works functions to be exercised by the city, including the supervision of all public works contracts;

E. Purchasing officer, in which capacity he shall purchase materials and supplies for the city, and direct the execution of all contracts pertaining thereto;

F. Building inspector, in which capacity he shall be responsible for all matters pertaining to the inspection of buildings and structures as prescribed in applicable codes adopted by the city;

G. Director of emergency services, as specified in Chapter 2.32;

H. Administrator of special districts within and outside of the city, when authorized by joint powers agreements between the city and other public entities;

I. Animal control officer, as specified in Title 6 of this code;

J. Any and all other offices which may be assigned by the city council from time to time.

2.20.060 - Implied power.

In addition to all the duties and responsibilities set forth in this chapter, the city manager shall have all power reasonably and necessarily implied in executing those duties and responsibilities.

2.20.070 - Manager-council relationship.

The council and its members shall deal with the administrative services of the city only through the city manager, except for purpose of inquiry, and neither the council nor any member thereof shall give orders to any subordinate of the city manager. The city manager shall take his orders and instructions from the council only when sitting in a duly held meeting of the council, and no individual councilman shall give any orders or instructions to the city manager. No individual councilman shall in any manner attempt to influence the city manager in the making of any appointment or in the purchase of equipment or supplies.

2.20.080 - Bond.

The city manager shall, at the expense of the city, execute a surety bond, in an amount established by the council, which bond shall also specifically include the duties of director of finance.
