Chapter 72 — BICYCLES

§ 72.01 LICENSE REQUIRED.

It shall be unlawful for any person to operate or use a bicycle propelled wholly or in part by muscular power upon any of the streets, alleys or public highway of the city, without first obtaining from the Riverbank Police Services Division a license therefor.

§ 72.02 APPLICATION.

The Riverbank Police Services Division is hereby authorized and directed to issue upon written application, bicycle licenses which shall be effective from January 1, 1980 and effective thereafter. The licenses shall be issued for a period of three years and the licenses must be procured on or before February 1 after each three-year period. The licenses when issued, shall entitle the licensee to operate such bicycle for which said license has been issued, upon all the streets, alleys and highways, exclusive of the sidewalks thereof. § 72.03 METALLIC LICENSE PLATE.

The city shall provide each year metallic license plates and seals, together with registration cards. The metallic license plates and seals shall have printed on them consecutive numbers assigned by the State Department of Motor Vehicles. The license plates shall be attached to the frame of each bicycle licensed. It shall be the duty of the Riverbank Police Services Division to attach the license plate to each bicycle licensed, and to issue a corresponding registration card to the licensee upon the payment of the license fee herein provided for. The metallic license plate shall remain attached during the existence of the license. The Riverbank Police Services Division shall also keep a record of the date of issue of each license, to whom issued, and the number thereof. § 72.04 LICENSE FEE.

(A) The annual license fee to be paid for each bicycle shall be as follows:

  • (1) For each new bicycle license and registration certificate, the sum shall not exceed $2 per year or any portion thereof;

  • (2) For each transfer of registration certificate, the sum shall not exceed $1;

  • (3) For each replacement of a bicycle license or registration certificate, the sum shall not exceed $1; and

  • (4) For each bicycle license renewal, the sum shall not exceed $1 per year.

(B) All license fees collected under this chapter shall be paid into the general fund of the city. The license fees may

be changed from time to time by resolution of the City Council in accordance with the provisions of Cal. Veh. Code § 39004.

§ 72.05 REQUIREMENTS FOR SECOND HAND BICYCLE DEALERS.

(A) All persons engaged in the business of buying second-hand bicycles in the city are hereby required to make a weekly report to the Riverbank Police Services Division, giving the name and address of the person from whom each

bicycle is purchased, the description of each bicycle purchased, the frame number thereof, and the number of the metallic license plate found thereon, if any.

(B) All persons engaged in the business of selling new or second hand bicycles are hereby required to make a weekly report to the Riverbank Police Services Division, giving a list of all sales made by such dealers, which list shall include the name and address of each person to whom sold, the kind of bicycle sold, together with a description and frame number thereof, and the number of the metallic license plate attached thereto, if any. § 72.06 DUTY WHEN SELLING OR TRANSFERRING OWNERSHIP.

It shall be the duty of every person who sells or transfers ownership of any bicycle to report such sale or transfer by returning to the Riverbank Police Services Division the registration card issued to such person as licensee thereof, together with the name and address of the person to whom said bicycle was sold or transferred, and such report shall be made within ten days of the date of the sale or transfer. It shall be the duty of the purchaser or transferee of such bicycle to apply for a transfer of registration therefor within ten days of the sale or transfer. (`67 Code, § 9-3-5) Penalty, see § 72.99

§ 72.07 MUTILATING OR DESTROYING LICENSE PLATE.

It shall be unlawful for any person to wilfully or maliciously remove, destroy, mutilate or alter the number of any bicycle frame licensed pursuant to this chapter. It shall also be unlawful for any person to remove, destroy, mutilate or alter any license plate, seal, or registration card during the time in which such license plate seal or registration card is operative, provided, however, that nothing in this chapter shall prohibit the Riverbank Police Services Division from stamping numbers on the frames of bicycles on which no serial number can be found, or on which said number is illegible or insufficient for identification purposes.

§ 72.99 PENALTY.

Every person violating any of the provisions of this chapter shall be fined not more than $10. (`67 Code, § 9-3-8) (Ord. 108, passed 11-10-52)
