Chapter 117 — SECONDHAND DEALERS

§ 117.01 DEFINITION.

For the purpose of this chapter, the following definition shall apply unless the context clearly indicates or requires a different meaning.

SECONDHAND DEALER. Every person who engages in, or conducts the business of buying, selling, or exchanging used furniture, household furnishings, books, merchandise, or any other secondhand articles or things, including secondhand automobiles, wrecked automobiles and junk. The term “secondhand dealer” shall not include any person who buys, sells, or exchanges used cars which are in operable condition without major body damage, nor shall it include used or secondhand merchandise offered for sale by vendors at special community events. § 117.02 COMPLIANCE WITH REGULATIONS REQUIRED.

(A) It shall be unlawful for any person to engage in business as a secondhand dealer as defined in this chapter, unless such business is carried on, maintained, or conducted in compliance with the regulations in division (B).

(B) Such business carried on, maintained, and conducted must occur within authorized zone districts as established by Chapter 153 of this code, and such activites must comply with standards and criteria as may be adopted from time to time by the city.

§ 117.03 VIOLATION DECLARED PUBLIC NUISANCE.

Any secondhand business which is established, conducted, operated or maintained contrary to the provisions of this chapter shall be and the same is hereby declared to be unlawful and a public nuisance. The City Attorney shall upon the order of the Council immediately commence action or proceedings for the abatement and removal and enjoinment thereof in the manner provided by law and shall take such other steps and shall apply to such courts as may have jurisdiction to grant such relief as will abate and remove and enjoin the conduct of such business contrary to the provisions of this chapter.
