§ 35.01 MERIT SYSTEM; APPLICATION AND EXCEPTIONS.

(A) The City Manager shall formulate and recommend to the Council for its approval rules and regulations and amendments thereto pertaining to the operation of a merit personnel program. Such rules and regulations shall cover the selection, appointment, classification, promotion, demotion, suspension, retirement and termination of municipal service employees and all other matters governing the status of employees and conditions of their employment. Approval of such rules, regulations and amendments thereto shall be by resolution of the Council. (`67 Code, § 1-9-1)

  • (B) The provisions of the merit system established by this section and accompanying rules and regulations shall apply to all positions and employments in the municipal service except:

  • (1) Elective officers;

  • (2) The City Attorney;

  • (3) Members of appointive boards, commissions and committees; and

  • (4) Persons engaged under contract to supply expert, professional or technical services.

§ 35.02 CLASSIFICATION PLAN.

All positions of the municipal service shall be classified within a position classification plan, which shall be maintained and operated by the City Manager.

§ 35.03 INELIGIBILITY FOR EMPLOYMENT.

(A) Except as otherwise hereinafter provided, no person convicted of a felony or misdemeanor involving moral turpitude shall be eligible for employment in the accepted or competitive service of the city, provided, however, that the appointing authority may disregard such conviction if he finds and determines that mitigating circumstances exist, such as but not limited to evidence of rehabilitation, length of time elapsed since such conviction, the age of such person at the time of a conviction, or the fact that the classification applied for is unrelated to such conviction.

(B) The City Manager and the Sheriff's Commanding Officer of the city are hereby authorized to have access to the “State Summary Criminal History Information” as provided for in Cal. Penal Code § 11105. (`67 Code, § 1-9-5) (Ord. 77-5, passed 5-23-77)

§ 35.04 RETIREMENT CONTRACT.

An amendment to the contract between the City Council and the Board of Administration, California Public Employees' Retirement System is hereby authorized, a copy of the amendment being attached to Ordinance 2011-002 and by such reference made a part hereof as though herein set out in full.
