Sec. 30.28. - PARCEL MAPS AND FINAL MAPS REQUIRED:

A parcel map is required for subdivisions of four (4) or fewer parcels (minor subdivisions). A final map is required for subdivisions of five (5) or more parcels (major subdivisions). Final maps are submitted to the City after approval of a tentative map. Failure to file a parcel map or final map with the City in accordance with the applicable provisions of this Chapter within the prescribed time limit shall terminate all proceedings. After all time limits for the filing thereof shall have elapsed, any subdivision of the same land shall require the filing of a new tentative map and the payment of the required fees in accordance with the provisions of this Chapter.

Sec. 30.29. - PARCEL MAP AND FINAL MAP FORM AND CONTENTS:

Parcel maps and final maps shall be prepared as required by Government Code Section 66433 and in accordance with requirements specified in the City's application checklists for parcel maps and final maps.

Sec. 30.30. - PARCEL MAP AND FINAL MAP CONTENTS; PROCESSING:

A. Surveys and Monuments:

  1. Final maps and parcel maps shall be based upon a complete, precise, and accurate field survey of the land to be subdivided, prepared by a California-registered civil engineer or land surveyor.

  2. All found monuments, property lines, centerlines of streets, and alleys adjoining or within the subdivision shall be tied into the survey.

  3. At the time of making the survey for a final map or parcel map, the engineer or surveyor shall set sufficient, durable monuments which conform with Business and Professions Code Section 8771 so that another engineer or surveyor may readily retrace the survey.

  4. In conjunction with the filing of a final map or parcel map, at least one (1) exterior boundary line shall be monumented. Additional monuments shall be set as required by the City Engineer.

B. Phasing of Final Maps: Multiple final maps relating to an approved tentative map may be filed if:

  1. The subdivider states in the tentative map application the intention to file multiple final maps; or

  2. After filing of the tentative map, the Planning Commission and the subdivider agree to the filing of multiple final maps.

C. Separate Subdivision Numbers: Each final map which constitutes a part of the approved tentative map shall have a separate subdivision number.

D. The subdivider shall submit to the City Engineer the following items:

  1. Required filing fees.

  2. Applicants will submit digital plans for review and, upon approval of those plans by the City Engineer, submit two (2) copies of mylar plan sets for signature and recording purposes.

  3. A traverse sheet showing the mathematical computations, closure, and area calculations.

  4. Copies of complete field notes showing references, ties, locations, elevations, and other data relating to monuments and benchmarks set in accordance with the requirements of this Chapter.

  5. A statement that any improvements that have been completed prior to the filing of the final map have been completed in accordance with the plans and specifications, or a statement that the subdivider intends to install such improvements in the future and will enter into an agreement guaranteeing their installation by improvement security as specified in this Chapter.

  6. Three (3) copies of all plans, profiles, cross sections, and the specifications for the required subdivision improvements in accordance with the approved plans and specifications and design standards, to permanent line and grade.

  7. Three (3) copies of any conditions, covenants and restrictions for the proposed development.

  8. Title Report: A title report, showing the legal owners at the time of filing the final map and issued within six (6) months of application submittal, shall be submitted with the final map, accompanied by copies of all deeds and easement descriptions referenced in the report.

  9. Guarantee of Title: A guarantee of title, in a form acceptable to the City Engineer and City Attorney, shall be issued by a competent title company to and for the benefit and protection of the City and shall continue up to the instant of recording of the final map, guaranteeing that the names of all persons whose consent is necessary to pass a clear title to the land being subdivided, and all public easements being offered for dedication, and all acknowledgments thereto, appear on the proper certificates and are correctly shown on the map, both as to consents to the making thereof and affidavits of dedication where necessary.

  10. Deeds and Maps: The final map shall be accompanied by copies of deeds for all adjoining property, and copies of all maps referenced in the title report.

  11. Easements: The final map shall be accompanied by written evidence of rights of entry or permanent easements across private property outside of the subdivision that permit or grant access to perform necessary construction work or permit the maintenance of any sewer, water, electric and/or other facility.

  12. Improvement Plans and Agreement: Improvement plans and an improvement agreement as required by Article 6 of this chapter shall accompany the final map.

  13. Soils Report: A preliminary soils report prepared for the tentative map or tentative parcel map indicated the presence of critically expansive soils or other soil problems which, if not corrected, could lead to structural defects, the soils report accompanying the final map shall contain an investigation of each lot within the subdivision. The Director or City Engineer may require additional information or reject the report if it is found to be incomplete, inaccurate or unsatisfactory.

  14. Hydrology and Hydraulic Calculations: Complete hydrology and hydraulic calculations of all storm drains shall be submitted with the final map if determined necessary by the City Engineer.

  15. Other Reports: Any other data or reports deemed necessary by the Planning and Building Director and/or the City Engineer shall be submitted with the final map.

  16. Other information as identified on the City's submittal checklist for processing of parcel and final maps.

Sec. 30.31. - PARCEL MAP AND FINAL MAP REVIEW AND APPROVAL:

A. Review: The City Engineer shall review the final map or parcel map for conformance with the approved tentative map or tentative parcel map, conditions of approval, and all applicable requirements of this Chapter and the Subdivision Map Act. The City Engineer shall accept the map and notify the City Council pursuant to subsection C below within twenty (20) days of receiving the corrected map, all required certificates and submittals, and any required fees.

B. Dedications, Improvement Agreements, Maintenance Agreements, and Encroachment Agreements: Dedications, improvement agreements, maintenance agreements, and encroachment agreements associated with land development may be accepted and approved by the City Engineer.

C. Summary Vacation of Easements: The summary vacation of easements consistent with Streets and Highways Code, Chapter 4, Article 1, starting at Section 8330, may be accepted and approved by the City Engineer.

D. City Council Notification: The City Engineer shall notify the City Council at the next available regular meeting after the City Engineer receives and reviews a final map or parcel map and determines that the map is technically correct. The City Council agenda shall include notice of the City Engineer's pending approval or disapproval, which notice shall also be mailed to interested parties requesting notice.

E. Approval or Disapproval: The City Engineer shall approve or disapprove the final map within ten (10) days following the City Council meeting where notice was given pursuant to Subsection [D.] above.

F. Periodic Review: The City Council shall periodically review the delegation of authority for final map and parcel map approval granted to the City Engineer.

G. Recordation: Except as provided by Government Code Section 66493, after the City approves a final map or parcel map, the City Engineer shall transmit the map to the County Recorder. The final map or parcel map becomes valid and goes into effect after it is filed by the County Recorder.
