Sec. 3.93. - GENERAL PURPOSE:¶
A. In order to prevent or lessen practical difficulties and unnecessary hardship, inconsistent with the purpose and objectives of this Chapter, modifications to the requirements of this Chapter and other City sign regulations may be granted or conditionally granted relating to the number, location, height, and size of signs in conjunction with and as part of a comprehensive Planned Development Permit or Planned Community Permit.
B. No modification may be granted for approving signs prohibited by this Chapter.

Sec. 3.94. - FINDINGS REQUIRED:¶
A. No Modification may be granted pursuant to this subsection unless the following findings are made and supported by substantial evidence:
The proposed sign program as a whole to be approved through these modifications conforms to the purposes, basic objectives principles of this Chapter and, as applicable, also conforms to the objectives and purposes for Planned Development Permits; for Planned Community Permits and the purposes and objectives of any Precise Plan adopted for the subject area.
The proposed sign to be approved through these modifications will provide an environment of physical and functional desirability, in harmony with the character of the surrounding neighborhood or district;
The design and construction quality of the approved signs and in all aspects of the development as a whole exceed the quality standards typically required for new developments located in similar areas of the City;
The establishment, maintenance or operation of the approved signs will not, under the circumstances for the particular case, be detrimental to the health, safety, peace, morals or general welfare of persons residing or working in the neighborhood or be detrimental or injurious to property and improvements in the neighborhood, or to the general welfare of the City;
Such modifications and each of them are necessary to allow for equivalent site and business identification as provided for on other similar properties with signage conforming to the standards of the applicable Precise Plan and/or the sign regulations of this Chapter.
B. No Modification may be granted to the sign regulations adopted in the Downtown Precise Plan unless the findings necessary to grant a sign variance are made.

Sec. 3.96. - REVIEW AND APPROVAL PROCESS:¶
Sign modifications shall be processed and acted upon by the same authority, in the same manner and together with applications for Planned Development Permits, Planned Community Permits or Amendments to such Permits as is applicable for the proposed project.
