Sec. 27.70. - ARTICLE DEFINITIONS:¶
For the purposes of this Article, and in addition to the definitions set forth in Section 27.3 et seq. the following words and phrases shall have the meaning respectively ascribed thereto.
HEALTH DEPARTMENT: The Environmental Services Agency of the County.
REGISTRATION: The certificate of registration issued pursuant to the provision of this Article.

Sec. 27.71. - SCOPE:¶
The provisions of this Article shall not apply to any sanitary district, sanitation district or sewer maintenance district, nor shall they apply to any agency or institution of this City or of the County, the State or Federal government which engages in the cleaning of chemical toilets which are owned and operated by any of such governmental agencies or institutions.

Sec. 27.72. - REGISTRATION OF BUSINESS:¶
No person shall carry on or engage in the business of the cleaning of chemical toilets or engage in the business of disposing of the contents thereof in this City without a valid registration issued by the Health Department.

Sec. 27.73. - REGISTRATION OF EMPLOYEES:¶
No person shall clean chemical toilets or dispose of, or aid in the disposal of the contents thereof, for any person engaged in the business of cleaning chemical toilets or disposing of the contents thereof who has not been issued a valid registration by the Health Department.

Sec. 27.74. - APPLICATION FOR REGISTRATION:¶
All applications for registration under this Section shall be filed with the Health Department. The application shall contain the following information:
A. The full name(s) of the applicant, if the applicant(s) is or are individual(s), and the full name(s) of all partners, if the applicant is a partnership, or the full names of the principal officer(s) of the corporation if the applicant is a corporation.
B. The relationship or capacity of the person who signs the application to the applicant if the registration is not for an individual.
C. The place of business and place of residence of the applicant and of each partner or principal officer, if the applicant is a partnership or corporation, respectively.
D. The exact location of the place at which it is proposed to dispose of chemical toilet cleanings.

Sec. 27.75. - SIGNATURE REQUIRED:¶
The application required by the preceding Section shall be signed by the person who will be engaging in the business of cleaning chemical toilets, or by an authorized officer, if a corporation, or by the managing partner, if a partnership.

Sec. 27.76. - EXAMINATION:¶
Registration shall be issued only after a satisfactory examination of the applicant by a duly authorized representative of the Health Department covering the equipment to be used, the applicant's knowledge of sanitary principles and of the laws and ordinances affecting human health or nuisances, and the reliability of the applicant in observing sanitary laws, ordinances and directions, and in selecting individuals who shall be employed to clean out chemical toilets without endangering human health or comfort; and, further, only after examination of the place and manner of disposal of the cleanings proposed by such applicant.

Sec. 27.77. - ACTION BY HEALTH DEPARTMENT:¶
The Health Department shall act upon each application within thirty (30) days of the date of filing same.

Sec. 27.78. - DURATION OF ORIGINAL REGISTRATION; REAPPLICATION:¶
An original registration required under this Article shall be valid only for the unexpired portion of the calendar year in which application is made. Reapplication shall be made annually prior to expiration of the succeeding registration and shall be valid only for the calendar year for which issued. In no event shall a registration be valid subsequent to the end of the calendar year for which issued.

Sec. 27.79. - REGISTRATION CONDITIONS:¶
Applicants for registration under this Article may be registered under such terms, conditions, orders and directions as the Health Department may deem necessary for the protection of human health and comfort. The Health Department may require any and all persons who are registered with said Department pursuant to this Article to file with the Health Officer at any time and at such frequency or intervals as is desirable, a statement giving the name and address of the owner or tenant of each and every one of the premises where a chemical toilet shall have been cleaned out by or for such registrant and such statement shall also describe in precise terms the place where the cleanings shall have been disposed of and by whom. The Health Department may require such statements to be made under penalty of perjury before a notary.

Sec. 27.80. - CHANGE OF ADDRESS:¶
A change of business or residence address of any registrant under this Article, including that of a member partner or principal officer of a corporation of a partnership or corporation, respectively, which is registered, shall be reported in writing by registered mail by the registrant within two (2) days after such change of address.

Sec. 27.81. - REVOCATION:¶
Any registration issued under this Article may be revoked by the Health Department for cause on ten (10) days' notice to the registrant which notice shall be served by registered mail or in person at the latest place of residence or of business reported by the registrant.

Sec. 27.82. - RULES AND REGULATIONS:¶
The Health Department is hereby authorized to issue rules and regulations in pursuance of the purposes of this Article.

Sec. 27.83. - VIOLATIONS UNLAWFUL:¶
It shall be unlawful to violate any of the provisions of this Article or any order of the Health Department made pursuant to this Article for the protection of human health and comfort.
