Sec. 26.1. - ESTABLISHED; COMPOSITION:

A Reserve Police Corps to consist of not more than sixty (60) members is hereby created.

Sec. 26.2. - APPLICATION FOR MEMBERSHIP; ACCEPTANCE AND APPROVAL OF APPLICANTS:

Application for membership in the Reserve Police Corps established by the preceding section shall be made by application to the Chief of Police, and if accepted by the Chief of Police, shall be subject to approval by the City Manager.

Sec. 26.3. - CONTROL AND COMMAND; RULES AND REGULATIONS GENERALLY:

The Chief of Police shall have complete authority, control and command of the Reserve Police Corps established by Section 26.1 and shall promulgate all necessary rules and regulations for the operation and control of the Reserve Police Corps, which rules and regulations shall be subject to the approval of the City Manager.

Sec. 26.4. - COMPENSATION; WORKMEN'S COMPENSATION BENEFITS:

Except as otherwise provided herein, no compensation shall be paid for any duty performed by any member of the Reserve Police Corps established by Section 26.1; provided, however, that for extraordinary or nonroutine duty assignments as determined by the Chief of Police and approved by the City Manager compensation may be paid at an hourly rate in an amount set by the Council; and provided, further, that each member accepted, registered and appointed by the Chief of Police as set out in Section 26.2 shall be an employee of the City for the purpose of obtaining benefits under the workmen's compensation contract of the City with the State compensation insurance fund.

Sec. 26.5. - RIGHTS, POWERS, PRIVILEGES AND AUTHORITY OF MEMBERS:

All Reserve Police Corps members when on actual assigned duty shall have all rights, powers, privileges and authority of a regular member of the Police Department.

Sec. 26.6. - BADGES:

All members of the Reserve Police Corps established by Section 26.1, after appointment, shall be furnished with a distinctive badge indicating that they are special police officers.

Sec. 26.7. - IMPERSONATING MEMBER:

It shall be a misdemeanor for any person to represent himself as a member of, or to be connected with, the Reserve Police Corps, unless he is in fact a member thereof or connected therewith.

Sec. 26.8. - LEVEL I RESERVE OFFICER CERTIFICATION:

A Reserve Police Corps member who is issued a Level I reserve officer certificate before January 1, 1981, shall have the full powers and duties of a peace officer as defined in Penal Code section 830.1, provided that such member is determined by the Chief of Police to be qualified to perform general law enforcement duties by reason of his or her training and experience. A Reserve Police Corps member who desires to apply for a Level I reserve officer certificate shall submit, prior to July 1, 1984, a written statement under penalty of perjury that he or she had applied for, but was not issued, such certificate before January 1, 1981. A certificate issued under this Section shall be deemed to have the full force and effect of any Level I reserve officer certificate issued prior to January 1, 1981. The provisions of this Section implement the provisions of subdivision (b) of section 832.6 of the Penal Code as amended by chapter 446, Statutes of 1983.
