Sec. 23.1. - ADOPTION OF SYSTEM; PURPOSE OF CHAPTER:

In accordance with the powers granted by the Constitution of the State and the Charter of the City, the personnel system as set out in this Chapter is hereby adopted in order to establish an equitable and uniform procedure for dealing with personnel matters through a department of personnel, and to place municipal employment on a merit basis so that the best qualified persons available shall be brought into the service of the City.

Sec. 23.2. - SCOPE OF CHAPTER:

The provisions of this Chapter and the competitive service or merit system established and administered hereunder shall apply to all offices, positions and employments in the service of the City except the following, to which said provisions, service or system shall not apply except and to the extent otherwise, or to the contrary, expressly provided:

A. Elective offices or positions.

B. Positions of appointive boards, commissions and committees.

C. The positions of:

City Manager.

Assistant City Manager.

Assistant to the City Manager.

Secretary to City Manager.

Director of Human Resources—Personnel.

City Attorney.

Senior Assistant City Attorney.

Assistant City Attorney.

Finance Director.

City Clerk.

City Engineer.

Fire Chief.

Police Chief.

Library Director.

General Services Director.

Parks, Recreation and Community Services Director.

Community Development Director.

Police Captain.

Building Official.

Planning Director.

Housing and Redevelopment Director.

Administrative Secretary—exempt.

D. All positions under the jurisdiction of the Board of Port Commissioners of the Port of Redwood City.

E. Temporary or parttime positions.

Sec. 23.3. - CITY MANAGER; RESPONSIBILITY AND DUTIES:

As administrative head of the City government, the City Manager shall have the responsibility for making effective the purposes of this Chapter and shall have the following duties:

A. Supervise the administration of all provisions of this Chapter and the rules and regulations established hereunder, which do not specifically require his direct administration.

B. Supervise the preparation of rules and regulations and revisions and amendments thereto for consideration and adoption by the City Council.

C. Supervise the preparation of a position classification plan and all revisions thereto for submission to the City Council. After adoption of the plan by the City Council, the City Manager shall allocate all positions in the competitive service to the classes therein established.

D. Recommend a salary and wage plan to the City Council for its approval.

Sec. 23.4. - DIRECTOR OF PERSONNEL; DUTIES:

The Director of Personnel shall, under the supervision and control of the City Manager, have the following duties:

A. Administer all provisions of this Chapter and the rules and regulations established hereunder, which do not specifically require the direct administration of the City Manager.

B. Prepare rules and regulations and revisions and amendments thereto for consideration and approval by the City Manager.

C. Prepare a position classification plan and all revisions thereto for review and approval by the City Manager.

D. Advise and assist the City Manager in the preparation of a salary and wage plan.

E. Perform such additional duties as may from time to time be assigned by the City Manager consistent with the requirements of the City Charter and this Chapter.

Sec. 23.5. - ADOPTION OF RULES AND REGULATIONS FOR ADMINISTRATION OF EMPLOYER-EMPLOYEE…

The City Council, pursuant to authority granted in section 3507 of the Government Code of the State of California, may adopt after consultation in good faith with representatives of an employee organization or organizations, reasonable rules and regulations providing for the administration of employer-employee relations.

Sec. 23.6. - PERSONNEL RULES; ADOPTION, PUBLICATION:

The City Council may adopt rules and regulations providing for administration by or under direction of the City Manager of all matters pertaining to competitive service regarding applications, examinations, eligibility, promotions, compensation within classification, job analysis and specification, appointments, demotions, transfers, dismissals, rejections, suspensions, layoffs, reemployments, vacations, leaves of absence and any other matters necessary to carry out the provisions and purposes of this Chapter, and such rules and regulations shall be binding upon all City employees and officials including the Council.

The City Manager shall supervise the preparation of the rules and regulations and, following their adoption or revision, the City Manager shall set forth and publish them.

Sec. 23.7. - ELIGIBLE LISTS; SELECTION OF APPOINTEES:

Persons appointed to the competitive service shall be selected from applicants whose names have been placed on eligible lists in the order of their relative merit as determined by competitive examinations. Except as hereinafter provided, appointments to positions in the competitive service shall be made from the first three named applicants on an eligible list established for a position classification who are ready and willing to accept the position offered. Notwithstanding the foregoing, any person who:

A. Has successfully completed the competitive examination for appointment to positions within the classifications of police officer, police sergeant or firefighter; or

B. Has successfully completed a training program established by the City with respect to a classification within which such person seeks appointment to a position to provide affirmatively equal employment opportunity for members of races, nationalities, ethnic and cultural groups who have been denied historically in the United States such opportunities because of such race, nationality or ethnic or cultural background, shall be considered for appointment irrespective of such person's relative ranking in the competitive examination for a position in the classification of police officer, police sergeant, firefighter or any position in a classification for which such equal employment opportunity training program has been established, respectively.

Sec. 23.8. - POWERS TO TRANSFER, PROMOTE, ETC., EMPLOYEES:

The City Manager or any other officer, board or commission in whom is vested by law the powers to make transfers, promotions, demotions, reinstatements, layoffs, and to suspend, reject, or dismiss officers and employees, shall retain such power, subject to the provisions of this Chapter and the rules and regulations established hereunder, it being the intent and spirit of this Chapter to provide a fair and just approach to municipal employment in order that City officers and employees may be selected and promoted on a merit basis, but in no sense to impair the efficiency of the public service.

Sec. 23.9. - DISCRIMINATION:

No person in the competitive service, or seeking admission thereto, shall be employed, promoted, demoted or discharged, or in any way favored or discriminated against because of political opinions or affiliations, or because of race, creed, color, national origin, religious beliefs, sex or lawful activities in formally recognized employee organizations; and to the extent prohibited by applicable State or Federal law there shall be no discrimination because of age.

Sec. 23.10. - POLITICAL SOLICITATION BY CITY EMPLOYEES, ETC.:

No officer, agent, clerk or employee, under the government of the City and no candidate for any City office shall, directly or indirectly, solicit or receive, or be in any manner concerned in soliciting or receiving any assessment, subscription or contribution, whether voluntary or involuntary, for any political purpose whatever, from anyone on the employment lists or holding any position under the provisions of this Chapter.

Sec. 23.11. - ABOLITION OF POSITION OR EMPLOYMENT:

Whenever in the judgment of the City Council it becomes necessary in the interest of economy or because the position involved no longer exists, the City Council may abolish any position or employment in the competitive service, and the employee holding such position or employment may be laid off without filing written charges and without the right of appeal. Any appointing power may likewise lay off a permanent employee whenever lack of work or funds shall require a reduction in the number of employees. The name of such an employee so laid off shall be placed at the top of the appropriate employment list or lists, as provided by the rules and regulations.

Sec. 23.12. - CONTRACTS FOR CARRYING OUT DUTIES, ETC., UNDER CHAPTER:

The City Council may contract with any competent agency for the performance by such agency of such technical service in connection with the establishment of the personnel system or with its operation, as may be desired.
