Sec. 14.131. - PERMIT APPLICATION AND SUBMITTAL REQUIREMENTS:

A. An application for a building permit required by a code enforcement action shall be filed by the property owner or their duly authorized representative (applicant).

B. The submission shall be deemed incomplete if the building permit application is not fully executed, plans or documents are missing, and/or fees have not been paid within (60) calendar days of the application filing date.

C. If this deadline is not met, the permit application shall be deemed abandoned and automatically canceled, and code enforcement activity shall resume.

Sec. 14.132. - PLAN REVIEW RESPONSE:

A. Once plans are reviewed and comments are issued, the applicant must resubmit for re-review within thirty (30) calendar days from the date of the issuance of comments.

B. Failure to respond within the resubmittal timeframe shall result in the application being abandoned and canceled and code enforcement activity shall resume.

Sec. 14.133. - ONE-TIME EXTENSION:

A. The applicant may request one (1) extension for one of the submittal deadlines listed in Section 14.131 or Section 14.132, but not both. The request must be in writing, with justifiable cause demonstrating the need for an extension, and must be submitted before the submittal deadline.

B. All extension requests shall be reviewed and decided by the Chief Building Official or their designee.

Sec. 14.134. - INSPECTION REQUIREMENTS:

A. An initial inspection shall be scheduled and passed within sixty (60) calendar days from the permit issuance date.

B. Thereafter, subsequent inspections must be done at intervals not to exceed thirty (30) calendar days from the date of the last passed inspection.

C. The permit remains active only if each required inspection is completed and passed within the prescribed timeframe.

D. Failure to meet these inspection deadlines may result in the cancellation of the permit by the Chief Building Official and resumption of the code enforcement process.

Sec. 14.135. - PERMIT DURATION AND FINAL APPROVAL:

The building permit shall remain valid through the final inspection and approval, provided that all provisions of this Article are continuously satisfied.

Sec. 14.136. - FEES, DOCUMENTATION, REINSTATEMENT, AND CREDITS/REFUNDS:

Fees and Documentation. If a permit is canceled for failure to comply with any of the provisions of this Article, the following shall apply:

A. The applicant must resubmit a new permit application and provide a new set of plans and supporting documents.

B. The applicant must submit a reinstatement request in writing and shall include the following:

  1. A justifiable cause and demonstration for the permit reinstatement.

  2. A clear timeline for restarting and completing the remaining work.

C. The applicant is required to pay all new permit fees according to the current City fee schedule, including, but not limited to, plan review fees, permit issuance fees, and inspection fees.

D. The reinstatement and reissuance request for a building permit will be reviewed and acted upon by the Building Official to determine if reinstatement and reissuance are warranted or another form of compliance should be initiated through the code enforcement process.

E. No Refund or Credit. Any previously paid fees will not be refunded or credited toward the new permit application.
