Sec. 15.6. - PROHIBITION OF SMOKING IN PUBLIC PLACES AND WITHIN CERTAIN AREAS OF THE…

A. Smoking shall be prohibited in all public places within the City, except where such places do not fall within the definition of place of employment, as defined in California Labor Code Section 6404.5, as may be amended. Examples of places where smoking is prohibited include:

  1. Elevators and restrooms;

  2. Taxicabs and other means of public transit under the authority of the City and in ticket, boarding and waiting areas of public transit depots;

  3. Service lines;

  4. Retail stores;

  5. Retail food marketing establishments, including grocery stores and supermarkets;

  6. All areas available to and customarily used by the general public in all businesses and nonprofit entities patronized by the public, including, but not limited to, business offices, banks, hotels and motels;

  7. Restaurants and bars;

  8. Public areas of aquariums, libraries and museums;

  9. Any building or area which is used primarily for exhibiting any motion picture, stage drama, lecture, musical recital or other similar performance;

  10. Sports arenas and convention halls;

  11. Hotels;

  12. Every room, chamber and place of meeting or public assembly, including school buildings under the control of any board, council, commission, committee or agencies of the City or any political subdivision of the State during such time as a public meeting is in progress, to the extent such place is subject to the jurisdiction of the City;

  13. Doctors' offices, dentists' offices, waiting rooms, hallways, wards and semiprivate rooms of health facilities, including, but not limited to, hospitals, clinics and physical therapy facilities; and

  14. Polling places.

B. Smoking shall also be prohibited within the following areas of the public right-of-way:

  1. Pedestrian malls, as defined in Chapter 20, Article VIII (Pedestrian Malls); and

  2. Within twenty (20) feet of any entrance, exit, window, or other opening into a restaurant or bar.

C. Smoking is prohibited in all places within the City where smoking is prohibited pursuant to the State Indoor Clean Air Act of 1976, Health and Safety Code Section 118875 et seq.

D. Notwithstanding any other provisions of this Section, any owner, operator, manager or other person who controls any establishment described in this Section may declare that the entire establishment is a nonsmoking establishment.

Sec. 15.7. - POSTING OF SIGNS:

"No Smoking" signs with letters of not less than one (1) inch in height, or the international "No Smoking" symbol (consisting of a pictorial representation of a burning cigarette enclosed in a red circle with a red bar across it) shall be clearly, sufficiently and conspicuously posted in every building or other place where smoking is controlled by this Chapter, by the owner, operator, manager or other person having control of such building or place.

Sec. 15.8. - ENFORCEMENT AND PENALTIES:

A. Violations of this Article may be enforced by the City's law enforcement agencies, including Code Enforcement and the Chief of Police, or their designee.

B. In the performance of their duties of monitoring and enforcing compliance with the provisions of Labor Code Section 6404.5 or other provisions of this Article, all persons so authorized by Code Enforcement or the Chief of Police shall have the power, authority and immunity of a public officer to issue infractions or citations.

C. Any person who violates this Article shall be guilty of an infraction, punishable as set forth below, or issued citations as set forth below, at the discretion of the law enforcement agency, including code enforcement:

  1. A fine not exceeding one hundred dollars ($100.00) for a first violation.

  2. A fine not exceeding two hundred dollars ($200.00) for a second violation within one (1) year.

  3. A fine not exceeding five hundred dollars ($500.00) for each additional violation within one (1) year.

D. In addition to the above, the City may enforce this Article as authorized by the enforcement and penalties provisions of Article VI.
