Sec. 5.1. - ANIMAL CONTROL ORDINANCE OF SAN MATEO COUNTY ADOPTED BY REFERENCE:

A. The Animal Control Ordinance of San Mateo County, consisting of Chapter 6.04 of the Code of Ordinances of the County of San Mateo, California, as amended on January 9, 2024 and as it may be amended in the future is hereby adopted by reference except as expressly excepted or amended by the provisions of this Article.

B. In the event of any conflict between the provisions of Chapter 6.04 of the Code of Ordinances of the County of San Mateo, California, hereinafter referred to as "The San Mateo County Animal Control Ordinance," and the provisions of this Article, the provisions of this Article shall govern.

C. The following provisions of the San Mateo County Animal Control Ordinance are not adopted:

Sec. 5.2. - REGULATIONS FOR MAINTENANCE OF DOGS AND CATS:

A. It shall be unlawful, and it is declared to be a nuisance for any person or persons other than a duly licensed veterinarian to keep more than four (4) dogs and/or cats, or a combination thereof, but in no event more than two (2) dogs, over the age of three (3) months on any one lot less than one acre in area within the City.

B. It shall be unlawful, and it is declared to be a nuisance for any person or persons other than a duly licensed veterinarian to keep more than four (4) dogs and/or cats over the age of three (3) months on any one lot one acre or more in area within the City.

Sec. 5.3. - MAINTENANCE OF CERTAIN ANIMALS UNLAWFUL:

It shall be unlawful, and is declared to be a nuisance, to keep within the City any stallion, swine, bull, ram, billy goat, monkey, reptile or any animal not commonly domesticated; and no animal shall be kept within the City other than those specifically provided for in this Chapter.

Sec. 5.4. - SALE, ETC., IN PUBLIC PLACE OF FISH, ETC., AS PETS OR NOVELTIES UNLAWFUL:

No person shall display, sell or offer for sale, barter or give away upon any street, sidewalk or other public place within the City as pets or novelties, any fish, turtle, snake, lizard, chameleon, bird, cat, dog, fowl, guinea pig or other reptile or animal.

Sec. 5.5. - OFFERING ANIMAL OR FOWL AS INDUCEMENT TO ENTER CONTEST PROHIBITED:

No person shall give away, or offer, as an inducement to enter any contest, any fish, turtle, snake, lizard, chameleon, bird, cat, dog, fowl, guinea pig or other reptile or animal.

Sec. 5.6. - DOG OR CAT EXCRETA ON PUBLIC OR PRIVATE PROPERTY CONSIDERED NUISANCE;…

It is unlawful and a nuisance for any owner, keeper or other person in possession of any dog or cat to permit his or her dog or cat to discharge such animal's excreta on any public or private property within the City, other than the property of the owner of such dog or cat, if such owner, keeper or other person in possession does not immediately, after such discharge, remove such excreta from the public or private property, render such property in a clean condition therefrom and dispose of said excreta in a safe and sanitary manner by depositing it in a closed or sealed container in an appropriate sanitary receptacle. Visually disabled persons who use seeing eye animals are exempt from the provisions of this Section with respect to such animals.
