§ 4-2.301. Permit required.

It is unlawful for any person to conduct, or assist in conducting, any public dance hall, dancing club, or public dance in the City without the authority of a written permit issued by the Council. Permits to conduct such dance halls, dancing clubs, or public dances may be issued by the Council at any regular meeting with or without a hearing. The Council may, before issuing such permits, satisfy itself that the conduct of any such dance hall, dancing club or public dance will comport with the public welfare, and for this purpose, may consider any facts or evidence as to the location, character, reputation or moral fitness of those who will be in charge of such dance and any other fact deemed material in the matter.

Any permit issued pursuant to this article may be revoked at any time by the Council in its discretion.

§ 4-2.303. Rules regulating dances.

The Council may make and adopt appropriate rules governing dance halls, dancing clubs and public dances and may revoke or suspend permits issued for such dance halls, dancing clubs and public dances when the proprietor or person in charge thereof violates or permits any infraction of any such rules or any laws of the State or the City.

§ 4-2.304. Illumination of dance halls.

All public dance halls and places where public or club dances are held shall at all times, when open for dancing, be so illuminated that any and all dancers or persons therein can be clearly and plainly seen on any part of the public dance floor in any part of the building.

§ 4-2.305. Disorderly conduct of patrons.

It is unlawful for any person in charge of or owning or assisting in the management of any public dance hall, public dance or dancing club to permit any person to be or remain therein who is intoxicated, boisterous or disorderly. It is unlawful for any intoxicated, boisterous or disorderly person to enter, be or remain in, or to assist in, any such public dance hall, public dance or club dance. It is unlawful for any person to conduct him or herself in a boisterous or disorderly manner in any public dance hall, public dance or club dance.

§ 4-2.306. Exemptions from provisions.

The provisions of this article shall not apply to any one dance given for the purpose of raising funds for charitable purposes; provided, however, that any person or organization giving or conducting such a charitable dance shall first obtain a permit therefor from the Chief of Police. The Chief of Police may, in his discretion, refuse to issue such permit.
