5.72.470: GENERAL REQUIREMENTS:

No operator shall be deemed to be in violation of its permit if it shall fail to provide, either in whole or in part, the services otherwise required, without fault of permittee, if such performance is prevented by any of the following:

A. Acts of God;

B. Labor strikes and disputes;

C. Intervention of any government body; or

D. Any force reasonably beyond the control of the operator. (Ord. 1987 § 1, 1987: prior code § 29900)
