Article II — CERTIFICATE OF OCCUPANCY AND ZONING CLEARANCE

No building or land shall be occupied or used unless a certificate of occupancy, zoning clearance and a license for such use, where required, is first obtained from the department or person vested with the duty or authority to issue the same. (Ord. 1000 § 33.00(E), 1955)

A certificate of occupancy and zoning clearance shall be issued only after such new building, enlargement or alteration has been completed in conformity with the provisions of any regulating ordinance, and with any approved site plan and required conditions, and when the proposed use conforms to this title and required conditions. A. A certificate of occupancy and zoning clearance shall be issued for the reuse of an existing building, or the use of undeveloped land, only after the improvements for such building or land conform to the property development standards of this title. Where feasible, such standards shall include the provision of required walls, landscaping, parking, trash enclosures, street improvements, and all other improvements determined by the planning and community development department to be necessary or required by any regulating ordinance for the particular use.

B. The director of planning may refer any application for a certificate of occupancy to the planning commission for their review and approval. (Ord. 1000 § 33.00(E)(2), 1955)
