2.44.010 - Creation and establishment.

Pursuant to the provisions of Government Code Section 65900 of the state of California, there is created and established the office of zoning administrator, who shall be appointed by the city council.

2.44.020 - Powers and duties.

A. As provided by Government Code Section 65901, the zoning administrator shall hear and decide applications for conditional uses or other permits provided for in the zoning ordinance and establish criteria for determining such matters, and applications for variances from the terms of the zoning ordinances.

B. The zoning administrator shall have jurisdiction to act as hearing officer and be empowered to approve, approve subject to condition, revoke approval, deny, consider and/or investigate applications for variances, tentative parcel maps, special use permits and other permits as may from time to time be added to this section.

2.44.030 - Referral to council.

The zoning administrator shall have the discretion to refer any application to the city council.

2.44.040 - Compliance.

The zoning administrator shall give all proper and required notices of meetings and hearings as required by federal and state laws, and local ordinances.

2.44.050 - Additional rules and procedures.

The zoning administrator may adopt all rules and procedures necessary to conveniently carry out the duties of his office.

2.44.060 - Small variance defined—Application—Approval.

"Small variance" means a variance which does not exceed ten percent of the nonconforming lot size. An application filed for use of other activity on nonconforming lots, for which a permit is required, shall be in the form of a request for a special use permit, and may be approved by the zoning administrator.
