8050 - Adoption.

The building codes known as the "California Building Code", the "California Residential Building Code", and the "California Green Building Standards Code", 2025 Editions, as published in Part 2, Part 2.5, and Part 11 of Title 24 of the California Code of Regulations, the purpose and subject matter of which, among other things, is to regulate the erection, construction, enlargement, alteration, repair, moving, removal, demolition, conversion, occupancy, equipment, use, height, area, and maintenance of all buildings or structures in the City of Port Hueneme; providing for the issuance of permits and collection of fees therefore; providing for penalties for the violation thereof, and to protect the public health and safety, are hereby adopted and enacted as the primary building codes of the City and made a part of these Building Regulations by reference with the same force and effect as if fully set forth herein.

At least one (1) copy of these codes has been deposited in the Office of the City Clerk, and shall be at all times maintained by the City Clerk for use and examination by the public.

8051 - Building permit fees.

All references in the California Building Code(s) to fees, fee schedules, or similar fee Table(s) shall mean the permit fee schedule as established by Resolution of the City Council in accordance with Section 8012 herein.

8052 - Plan review fees.

When a plan is required to be submitted by Section 8010 of these Building Regulations or the California Building Code, a plan review fee must be paid to the Building Official as the City's designated official to collect the same at the time of submission of plans and specifications. Plan review fees are a fixed percentage of the building permit fees as established by Resolution of the City Council in accordance with Section 8012 herein.

When plans are incomplete or are changed so as to require additional plan review, an additional plan review fee shall be charged at a rate established by the Building Official but not to exceed one-half (½) the initial plan review fee. The Building Official may waive such fee for minor additional plan reviews on incomplete or changed plans.

Corrected plans which are resubmitted to the Division of Building and Safety for approval subsequent to an initial plan review shall not be subject to an additional plan review fee.

(a) Plan Check Fee—Two (2) or More Buildings on Same Parcel. When two (2) or more buildings are to be erected on the same parcel and all of the buildings are shown on one set of plans, the plan checking fee shall be indicated for the sum of the values of all the separate buildings.

(b) Plan Check Fee—Two (2) or More Identical Buildings. When two (2) or more buildings are to be erected from identical plans and specifications, the plan check shall be the fee indicated for the sum of the values of all separate buildings.

8053 - Fee refunds.

All references in the California Building Code(s) to fee refunds are superseded by Section 8013 of these Building Regulations.

8054 - Fire classification—General.

Table 1505.1 of the California Building Code is amended to read as follows: Minimum roof covering classifications for all types of construction is Class B.

8055 - Residential foundation design.

  1. Residential Foundation Design shall be according 2025 CRC chapter 4, except as amended below. Residential foundations for three-story and above structures, or are on unstable soils, or of unusual shapes beyond the limits of the CRC, shall be designed by a licensed Professional Engineer and/or Architect. The following amendments shall be adopted for said foundations:

(a) Shall have a 27" minimum depth for all footings.

(b) Foundation design when buildings are located on expansive soil having an expansion index greater than 50, gutters, downspouts, piping, and other non-erosive devices must be provided to collect and conduct rain water to pervious areas, such as yards, open channels, or vegetated areas. Routing rooftop runoff via yard drains to the roadway or the storm water conveyance system is not permitted.

  1. Structural Design of Commercial Buildings shall be designed by a licensed Professional Engineer and/or Architect according to the 2025 CBC.

8056 - Swimming pool enclosures and safety devices.

2024 ISPSC Section 202 DEFINITIONS:

  1. Barrier; A barrier is a fence, wall, building wall, or any combination of these that completely surrounds the swimming pools and obstructs access to the swimming pool.

  2. Swimming Pools. Any body of water created by artificial means which is designed, intended for use, or used for swimming or immersion purposes, which has a water depth exceeding eighteen (18) inches. The term, "pool," includes swimming pools, spas, hot tubs, above- and below-ground, and vinyl-lined pools; pool does not include plumbing fixtures such as bathtubs nor does it apply to man-made lakes, reservoirs, farm ponds, or ponds used primarily for public park purposes, water conservation purposes, irrigation purposes or for the watering of livestock.

General. The design and construction of swimming pools, spas and hot tubs shall comply with the 2024 ICC Swimming Pool and Spa Code (ISPSC).

Swimming Pool and Spa Barrier height and clearances shall be enforced as follows:

Barrier height and clearances. The top of the barrier must be at least sixty (60) inches above grade measured on the side of the barrier that faces away from the swimming pool. The maximum vertical clearance between the grade and the bottom of the barrier must be two (2) inches measured on the side of the barrier that faces away from the swimming pool. Where the top of the pool structure is above grade, the barrier is authorized to be at ground level or mounted on top of the pool structure, and the maximum vertical clearance between the top of the pool structure and the bottom of the barrier shall be less than four (4) inches.

Openings. Openings in the barrier must not allow passage of a four (4)-inch-diameter sphere.

Solid barrier surfaces. Solid barrier surfaces which do not have openings shall not contain indentations or protrusions except for normal construction tolerances and tooled masonry joints.

Closely spaced horizontal members. Where the barrier is composed of horizontal and vertical members and the distance between the tops of the horizontal members is less than forty-five (45) inches, the horizontal members shall be located on the swimming pool side of the fence. Spacing between vertical members shall not be greater than one and three-quarters (1¾) inches in width. Where there are decorative cutouts within vertical members, spacing with the cutouts shall not be greater than one and three-quarters (1¾) inches in width.

Widely spaced horizontal members. Where the barrier is composed of horizontal members and the distance between the tops of the horizontal members is forty-five (45) inches or more, spacing between the vertical members must not be greater than four (4) inches. Where there are decorative cutouts within vertical members, spacing must not be greater than one and three-quarters (1¾) inches in width.

Chain link dimensions. Mesh size for chain link fences must not be greater than one and three-quarters (1¾) inches in width, unless the fence is provided with slats fastened at the top or bottom that reduce the openings to not more than one and three-quarters (1¾) inches in width.

Diagonal members. Where the barrier is composed of diagonal members, the members shall not be greater than one and three-quarters (1¾) inches in width.

Gates. Access gates must comply with the requirements of the 2024 ISPSC and must be equipped to accommodate a locking device. Pedestrian access gates must open outward away from the pool and must be self-closing and have a self-latching device. Doors or gates other than pedestrian access gates must have a self-latching device and must be equipped with lockable hardware or padlocks and must remain locked at all times when not in use. Release mechanisms must comply with CBC Section 1010.2 . Where release mechanisms of the self-latching device are located less than sixty (60) inches above grade measured on the side of the barrier that faces away from the swimming pool, the release mechanism must be located on the pool side of the gate at least three (3) inches below the top of the gate and the gate barrier may have no opening greater than one-half (½) inch within eighteen (18) inches of the release mechanism.

Dwelling wall as a barrier. Where a wall of a dwelling serves as part of the barrier, two safety devices must be provided in accordance with Section 115922 of the California Health and Safety Code.

Pool structure as barrier. Where an above-ground pool structure, and the means of access is a ladder of steps, then the ladder or steps either shall be capable of being secured, locked or removed to prevent access, or the ladder or steps shall be surrounded by a barrier. Where the ladder or steps are secured, locked or removed, any opening shall not allow the passage of a four (4)-inch-diameter sphere.

Indoor swimming pools. Walls surrounding indoor swimming pools shall not be required to comply with additional barrier elements.

Prohibited locations. Barriers shall be located as to prohibit permanent structures, equipment or similar objects from being used to climb the barriers. There shall be a clear zone of not less than thirty-six (36) inches between the exterior of the enclosure and any permanent structures or equipment such as pumps, filters and heaters that can be used to climb the enclosure.

8057 - Residential foundation minimum size.

Section R403.1.1 of the California Residential Code is amended to read as follows:

R403.1.1 The minimum width, (W), and thickness for concrete footings must be in accordance with Table 403.1 and Figure R403.1(1) or Figure R403.1.3, as applicable. The footing width must be based on the load-bearing value of the soil in accordance with Table R401.4.1. Footing projections, (P), must be not less than two (2) inches and may not exceed the thickness of the footing. Footing thickness and projection for fireplaces must be in accordance with Section R1001.2. The size of footings, supporting piers and columns will be based on the tributary load and allowable soil pressure in accordance with Table R401.4.1. The minimum depth of footings into undisturbed natural soils, or engineered fill, shall be of 27 inches minimum, not including the thickness of the slab, and there shall be (2) #4 rebar near the top and the bottom of the footing (in addition to the slab reinforcement).
