Chapter 4 — PROCEDURE FOR LEASING COUNTY REAL PROPERTY

Sec. 7-4.01. - Bidding procedure.

Pursuant to Section 25537(a) of the Government Code, any real property belonging to, or leased by, the County may be leased by the Board's acceptance of the highest proposal for the proposed lease submitted in response to a call for bids posted in at least three (3) public places for not less than fifteen (15) days and published for not less than two (2) weeks in a newspaper of general circulation in the County; provided that the Board reserves the right to reject all bids. Following the acceptance by the Board of the highest proposal, the Public Works Director is authorized to execute the lease on behalf of the County.

Sec. 7-4.02. - Leases excluded from bidding procedure.

Pursuant to Section 25537(b) of the Government Code, leases proposed for a nonrenewable term not to exceed ten (10) years, and having an estimated monthly rental not to exceed Five Thousand and no/100ths ($5,000.00) Dollars, shall be excluded from the bidding procedure set forth in Section 7-4.01 and shall follow the procedure which follows. Notice shall be posted in the County Clerk's office and shall describe the property proposed to be leased, the terms of the lease, the location where offers to lease the property will be accepted, the location where the lease will be executed, and any county officer authorized to execute the lease.
