§ 5.20.010. Purpose.

The purpose of this article is to establish those businesses and/or employees that require a permit prior to the commencement of operation. Permits are issued for businesses that do not require the approval of all departments regularly required in approving general business licenses and special business licenses.

§ 5.20.020. Approval process.

All applications for a permit shall be filed with the tax collector. The tax collector shall collect the required fee for the application as specified in Section 5.08.030, assure the application is complete and forward the application to the sheriff's department for processing, investigation and approval if required. If the permit is denied, the applicant will be informed in writing and advised of his or her right to appeal.

§ 5.20.030. Issuance of business permit.

A. Upon approval by the tax collector and sheriff if required, the permit will be issued to the applicant. All permits are issued by the tax collector with the exception of cardroom dealer permits which are issued by the sheriff and whose fee is determined by the sheriff's department.

B. A permit will not be issued if any of the following conditions exist:

  1. The issuance of such a permit would be detrimental to the public's health, safety or welfare;

  2. The applicant has been convicted of a felony or a crime involving moral corruption;

  3. The applicant has made a wilfully false statement on his or her application;

  4. There exists grounds for refusal under Section 5.08.200;

  5. The applicant has failed to comply with applicable state requirements.

§ 5.20.040. Business permit suspension.

The sheriff shall have the authority summarily to suspend any permit issued under this section if he or she has reasonable cause to believe that there are grounds for revocation under Section 5.08.210.

Additional fees may be required of business permit applicants for those applications that need approval by the sheriff's department.
