Chapter 23.74 — BED AND BREAKFAST INNS

§ 23.74.010. Purpose.

The purposes of this chapter are to:

  • (1) Provide the opportunity for the establishment of bed and breakfast inns in structures of historical and/or architectural significance in any district;

  • (2) Maintain certain structures which are unique and contribute to and enrich the aesthetic appeal of the neighborhood and community;

  • (3) Establish site development standards which will provide the opportunity for bed and breakfast inns while maintaining the visual character of residential neighborhoods and the community.

§ 23.74.020. Definition.

“Bed and breakfast inn” means a residential dwelling in which rooms are rented to paying guests on an overnight basis with breakfast served daily, the entire service to be for one stated price for a total period of time not to exceed fourteen (14) days during any consecutive ninety (90) day period. (Ord. 87-O-105, 1987)

§ 23.74.030. Designation.

One (1) bed and breakfast inn shall be permitted only on parcels and within a structure(s) which meet all the following conditions:

  • (1) Are existing legally subdivided lots located in approved zones within the city;

(2) Are in structures designated as being architecturally and/or historically significant by the city. (Ord. 87-O-105, 1987)

§ 23.74.040. Procedure.

Each bed and breakfast inn shall require a use permit pursuant to Chapter 23.87 and shall comply with the following:

  • (1) Prior to application, an applicant shall pay the required fee and request an inspection of the property by the building official to determine compliance with current building and zoning codes. The building official shall file a written report indicating, if necessary, the nature and amount of work required to have the subject site and structure(s) comply with current code.

  • (2) The applicant shall submit an application in accordance with submittal requirements on file with the planning division.

  • (3) The applicant may request the planning commission to consider the inclusion of a structure (not previously designated) on the city’s list of historically and/or architecturally significant structures.

§ 23.74.050. Standards.

Bed and breakfast inns shall comply with the following development standards:

  • (1) Individual bed and breakfast units shall not contain cooking facilities.

  • (2) No meals shall be served to guests other than breakfast. Said breakfast meal, if served, shall be served only to registered overnight guests.

  • (3) Parking required shall be: one (1) parking space for each rental room in the residence, in addition to the required parking of the district as stated in Chapter 23.78 , off-street parking, of the Placentia Municipal Code.

  • (4) Signage shall be limited to one wall sign not to exceed three (3) square feet of sign area. Sign wording shall consist of the name of the occupant or establishment located on premises, and/or description of service rendered. Establishment shall be referred to as an “Inn.” Such sign shall be attached to and parallel with the front wall of the building.

  • (5) A business license shall be obtained in accordance with Placentia Municipal Code Title 6.

(6) All bed and breakfast inns shall be subject to hotel-motel room tax. (Ord. 87-O-105, 1987)

§ 23.74.060. Additional requirements.

Bed and breakfast inns shall be subject to the following requirements:

  • (1) The bed and breakfast use shall be shown not to be detrimental to the neighborhood;

  • (2) The primary use shall be residential and retained in a manner which will allow reconversion back to a residential use;

  • (3) An owner, manager, proprietor or caretaker of the property must reside on the subject premises at all times;

  • (4) The provisions of Municipal Code Chapter 23.78 , use permits, shall apply to all bed and breakfast inn uses and said use permit, if issued, shall run with the title of the subject property.
