§ 8.32.010. Cover, fence and gate requirements.

  • A. Every person in possession of land within the city, either as owner, purchaser under contract or otherwise, fee holder, lessee, tenant or licensee, upon which there is situated any man-made excavation, including, but not intended to exclude, other man-made excavations thereby, oil-well sumps, quarries, ditches or mines, where such man-made excavation is three feet or more in depth, shall either cover it or shall erect a fence or other solid structure not less than five feet in height above the underlying ground, with no opening therein, other than doors or gates, larger than three inches square.

  • B. This section shall not apply to any man-made excavation during the course of the construction of the same, where the same is being excavated in accordance with a permit issued for that purpose or a related purpose under any other chapter of this code, provided the provisions of such permit and said chapter are fully complied with at all times.
