Sec. 9.20.010. - Dice, card games prohibited; penalties.

Every person who deals, plays, or carries on, opens, or causes to be opened, or who conducts for hire, either as owner or employee, any game played with cards, dice, or any device of draw poker or any other game not mentioned in section 330 of the California Penal Code, for money, checks, credit or other representative of value, and every person who plays or bets at or against any of said prohibited games, is guilty of a misdemeanor, and is punishable as provided in section 1.16.010. Section 9.20.020 provides a narrow exception to this paragraph.

Sec. 9.20.020. - Charitable organizations; gaming allowed in exchange for donations.

A duly licensed charitable or nonprofit organization may conduct a gaming event as a fund-raiser where each and all of the following conditions are present:

(1) An application for permit to conduct such an event shall be made to and approved by the city council.

(2) Not more than one permit per year shall be issued to a particular organization.

(3) The gaming shall be conducted within the hours of 6:00 p.m. and 12:00 midnight.

(4) A specific number of free chips given to each participant in exchange for the purchase of a dinner ticket or entertainment ticket, but free chips are available on request to those not purchasing a ticket.

(5) The proceeds of the donation must be used for the benefit of the charitable or nonprofit organization.

(6) Chips shall not be redeemed for cash but may be redeemed for merchandise prizes by auction at the end of the evening.

(7) Later issuance of chips by the organization may be made in exchange for cash donations. Where such later issuance occurs, an equal amount of chips must be issued free by the organization to anyone so requesting.

(8) The organization shall post a sign at the entrance and also in a conspicuous place on the premises where the event is being conducted. The sign should restate the regulations as they appear in subsection (7) of this section.
