Sec. 7.12.010. - Definitions.

The definitions set forth in California Health and Safety Code §§ 12501 through 12534 (Fireworks and Pyrotechnic Devices—General Provisions and Definitions), as amended, shall be effective as definitions of the words, terms and phrases used in this chapter. All words, terms and phrases used herein, other than those specifically defined elsewhere in this chapter, shall have the respective meanings ascribed to them in California Health and Safety Code §§ 12501 through 12534, as amended, and shall have the same scope and effect that the same words, terms and phrases have where used in California Health and Safety Code §§ 12501 through 12534, as amended.

Sec. 7.12.020. - Prohibited; exception.

It is unlawful for any person, firm or corporation to have in his or its possession, or to keep, store, use, shoot, discharge, set off, ignite, manufacture, sell, give or transport, any fireworks within the city, except for use in a public display of fireworks, pursuant to a permit obtained under the provisions of sections 12640 through 12654, as amended, of the Health and Safety Code of the state.

Sec. 7.12.030. - Violation; penalty.

Any person violating any provision of this chapter or failing to comply with any of the requirements herein is guilty of a misdemeanor which may, in the discretion of the enforcing authority, be charged and prosecuted as an infraction.
