2.385.010 - Employees authorized to arrest for violations of Titles 14 and 17 of this code.

Pursuant to California Penal Code Section 836.5(a), any senior inspector or building inspector employed by the city, and designated by the city manager pursuant to Section 2.385.030, is authorized to and may arrest a person without a warrant whenever the senior inspector or building inspector has reasonable cause to believe that the person to be arrested has committed a misdemeanor in the senior inspector or building inspector's presence which is a violation of Title 14 or Title 17 of this code, which titles senior inspector and the building inspector has the duty to enforce.

2.385.020 - Employees authorized to arrest for violations of Titles 6 and 8 of this code.

Pursuant to California Penal Code Section 836.5(a), any public health sanitarian, vector control officer, or environmental health technician (health employee) employed by the city, and designated by the city manager pursuant to Section 2.385.030, is authorized to and may arrest a person without a warrant whenever the health employee has reasonable cause to believe that the person to be arrested has committed a misdemeanor in the health employee's presence which is a violation of Title 6 or Title 8 of this code, which titles the health employee has a duty to enforce.

2.385.025 - Employees authorized to arrest for violations of Title 10 of this code…

Pursuant to California Penal Code Section 836.5(a), any employee of the city department of public works and transportation, who has been designated by the city manager pursuant to Section 2.385.030, and approved by the chief of police pursuant to Section 10.12.010 is authorized to and may arrest a person without a warrant whenever the employee has reasonable cause to believe that the person to be arrested has committed a misdemeanor in the employee's presence which is a violation of any provision of Title 10 of this code regulating the parking and standing of vehicles.

2.385.030 - Designation of employees by city manager.

The city manager shall designate in writing by name and job classification all employees who are to be authorized to make arrests pursuant to this chapter, and the names and job classifications shall be reported in writing to the city council and filed with the city clerk before such authorization shall be effective. The designation shall be in the discretion of the city manager, and nothing contained herein shall require the city manager to designate persons employed in job classifications named in this chapter to be able to arrest as authorized by this chapter.

2.385.040 - Revocation of authorization.

The authorization to arrest and issue citations provided in this chapter shall automatically and immediately terminate upon the employee's discontinuing employment with the city, upon the employee's suspension from duty, or upon the receipt of notice in writing from the city manager that the employee's authority to arrest pursuant to this chapter has been revoked. The city manager shall report in writing to the city council the names and job classifications of all employees whose authority to arrest has been terminated, and the report shall be filed with the city clerk. The termination or revocation of authority to arrest pursuant to this section shall not affect the validity of an arrest made prior to such termination or revocation.
