12.04.160 - Commercial construction defined.¶
"Commercial construction," as referred to in this article, means the construction, reconstruction or change of use of any building or structure to be used for business, commercial or industrial purposes. It does not include minor repairs or alterations to existing structures when the use or function of such structure is not changed.

12.04.170 - Installation required— Standards.¶
Every property owner or person in possession of property, and every builder, contractor or agent engaging in or allowing construction of, or change of use of, a commercial building, shall install curbs, gutters and sidewalks on all street frontage to be developed in accordance with the standards adopted and approved by the city council of the city pursuant to Section 12.04.020 of this code.

12.04.180 - Modification of existing curbs, gutters and sidewalks required.¶
Should curbs, gutters and sidewalks exist along the street frontage of the property upon which a commercial building is to be constructed, or its use changed, then any deficiencies in those existing curbs, gutters and sidewalks shall be modified to achieve conformance with above-mentioned standards.

12.04.190 - Inspection of forms.¶
The city engineer shall inspect and approve all forms for curbs, gutters and sidewalks before the placing of concrete.

12.04.200 - Violation—Penalty.¶
Any property owner, or person in possession of property, builder, contractor, agent, or any other person violating any of the provisions of Section 12.04.170 or 12.04.180 of this code, shall be guilty of a misdemeanor and upon conviction thereof, shall be punishable by a fine of not more than one thousand dollars ($1,000.00), or by imprisonment for a period not exceeding six months, or by both such fine and imprisonment as provided for in Section 1.12.010 of this code. In addition, any such person violating any of the provisions of this article shall be liable for the cost of removing and or replacing any curbs, gutters or sidewalks not in conformance with the standards adopted by the city council, and the city shall have the right to institute in a court of competent jurisdiction, an action at law against each and every violator jointly and severally, for recovery of such costs.
