5.36.010 - Permit required—Intoxicants prohibited.

A. No public dance shall be conducted without a permit except as provided for in Section 5.12.180.

B. No permit shall be issued which permits dancing, the conduct of a dance hall or a public dance in any establishment or any premises located in a commercial zone district which has been licensed by the California Department of Alcoholic Beverage Control or which otherwise provides for the sale or service of alcoholic beverages.

C. Any existing permits or license which permits dancing, the conduct of a dance hall or a public dance in any establishment or any premises located in a commercial zone district which has been licensed by the California Department of Alcoholic Beverage Control or which otherwise provides for the sale or service of alcoholic beverages is revoked on the effective date of the ordinance codified in this section.

5.36.020 - Hours of dancing.

A. No dancing shall be permitted at the premises described in Section 5.36.010 during the hours of two a.m. and six a.m. inclusive.

B. No person under the age of eighteen years shall be permitted on the premises described in Section 5.36.010 at any time when intoxicating beverages are sold.

5.36.030 - Security.

No dancing shall be permitted at the premises described in Section 5.36.010 unless one or more security officers are supplied by the promoter of such dancing to maintain order and patrol the premises during any such dancing. The security officers may be either employees of a licensed security patrol firm, off-duty peace officers, or off-duty police reserve officers. The security officers provided for in this section shall be subject to the supervisions and direction of the chief of police and his agents with regard to the manner in which they exercise their responsibilities.

5.36.040 - License—Revocation.

A license for dancing at the premises described in Section 5.36.010 shall be subject to revocation by the city council for cause when conditions warrant, which conditions shall include, but not be limited to, the creation of a public nuisance, the inability of the promoter to maintain order and tranquility, or the attendance of a minor at the dancing.

5.36.050 - Violation—Penalty.

Any person, firm, or corporation violating this chapter shall be guilty of an infraction.
