Sec. 2-2-181. - Permits required in unincorporated areas.¶
No person or other legal entity, whether profit or nonprofit, shall engage in any business or other activity which is regulated by this article and which is located in unincorporated territory and adjacent to any harbor under the jurisdiction of the County, without first obtaining, and thereafter renewing as required, a permit therefor issued by the Director or designee, for such fee, and valid for such term, as provided by resolution of the Board. The fee, in cash or check, shall be paid when the application is filed. A violation by any permittee of the applicable provisions of this article or of the conditions of his permit shall be grounds for its suspension or revocation, after due notice and opportunity to be heard by the Director, as to suspension, and by the Commission, as to revocation, in accordance with procedures established by resolution of the Board.

Sec. 2-2-182. - Permit for bait selling.¶
No person shall sell live bait using live bait receivers located within the waters of a harbor without first obtaining a permit from the Director. No permit shall be issued until the design of the receiver or receivers is approved by the Director. The permit shall be issued for an indeterminate period.

Sec. 2-2-183. - Live bait receivers defined.¶
A live bait receiver is an object for confining live bait which is afloat in the waters of a harbor, either moored to a pier, bulkhead or seawall, or moored by means of an anchor or other weight to the bottom of the harbor; provided, however, that a live bait receiver shall not be deemed to be a "structure" within the meaning of article 10 of this division.

Sec. 2-2-184. - Requirements for live bait receivers.¶
All live bait receivers used within the waters of a harbor shall be provided with screen trays in the bottom thereof so as to retain all dead bait within the receiver, which can be raised to dispose of said dead bait. They shall also have a screen or solid cover which fits closely unless the receiver is completely covered by a roof.

Sec. 2-2-185. - Removal of nonconforming bait receivers.¶
Storage of live bait other than in a receiver conforming to the requirements hereof is prohibited. After written notice to the owner of a nonconforming receiver, it may be removed by the Director and stored at the expense of the owner.

Sec. 2-2-186. - Commercial bait boats.¶
All boats used to catch or furnish live bait shall, at all times, have aboard a covered receptacle in which shall be placed all dead bait. Bait tanks on such boats when containing bait shall be covered at all times when in a harbor by a cover which fits closely over the top except while bait is actually being transferred to or from the tank.

Sec. 2-2-187. - Disposal of bait.¶
No person shall place or allow to be placed any live or dead bait in the unconfined waters of a harbor except when it is attached to a hook or hooks in the act of fishing.

Sec. 2-2-188. - Sale or transfer of bait.¶
No person shall sell live bait at retail from a vessel within a harbor, and no person shall transfer live bait from one vessel to another vessel within the limits of a harbor except when such vessels are moored to a pier and are within the pierhead line; provided, however, that during a period of adverse weather conditions causing such sale or transfer from offshore receivers to be hazardous, a location inside a harbor may be used with the approval of the Director.
