(a)

Effective February 10, 2001, each member of the Board of Supervisors shall be compensated for his or her services as such member by salary at the rate of one hundred eight thousand dollars ($108,000.00) per annum. No member of the Board of Supervisors shall receive any compensation, in addition to that provided for by this section, for services rendered as a member of the Board.

(b)

Effective July 1, 2002, and on the same date each succeeding calendar year, the salary for each member of the Board of Supervisors shall be increased by twelve (12) percent.

(c)

Effective October 3, 2025, the rate of pay for each member of the Board of Supervisors shall be set as a biweekly rate of pay based on subsection (d) below. The biweekly rate shall be consistent with the regular payroll cycles of the County's payroll operations and shall be paid at the same times and in the same manner as for County employees generally.

(d)

Notwithstanding the provisions of subsection (b) above, the salary for a member of the Board of Supervisors shall be set at an annual base salary rate equal to the regular annual salary prescribed by State law and as adjusted by State law for judges of the Superior Court of the State of California.

(e)

If any provision of this section, or the application thereof to any person in any circumstance, is held invalid, the remainder of the section, or the application of such provision to other persons and to other circumstance, shall not be affected thereby. The Board of Supervisors expressly declares its intention that subsection (b) of this section shall be fully operative and effective except as limited by subsection (d), and that if subsection (d) should be declared invalid, there should be no limitation upon the effectiveness or operability of subsection (b). The Board of Supervisors would have enacted subsection (b) without regard to subsection (d). Subsection (b) shall be deemed severable from subsection (d). If subsection (d), or any provision thereof is held invalid, then subsection (b) shall be deemed, notwithstanding such invalidity, to be fully effective and operable during the period of invalidity of subsection (d) preceding the determination of invalidity as well as thereafter.

(f)

Each member of the Board shall also be provided with either the use of a County provided automobile or an automobile allowance, such health and welfare benefits and life insurance benefits and retirement as provided County Executive Management-Group I employees, and a contribution of six (6) percent of salary to a County offered deferred compensation plan.

(g)

This compensation shall not be in lieu of any compensation for any service in any other capacity or on any other board or commission.

(a)

It is hereby found and declared, pursuant to section 33101 of the Community Redevelopment Law, that there is a need for the redevelopment agency created by said Law to function in the County of Orange and said agency is hereby authorized to transact business and exercise its powers under the Community Redevelopment Law.

(b)

The Board of Supervisors of the County of Orange, California, hereby declares itself to be the redevelopment agency to be known as County of Orange Development Agency and finds that such action will serve the public interest and promote the public safety and welfare in an effective manner. All rights, powers, duties, privileges and immunities vested by the Community Redevelopment Law in such agency shall be, and are, vested in this body.

(a)

In accordance with Health and Safety Code Section 34193, and based on the Recitals set forth in Ord. No. 11-015, the Board of Supervisors hereby determines that the County shall comply with the provisions of Part 1.9 of Division 24 of the Health and Safety Code, as enacted by AB 1X 27.

(b)

Except as set forth below, the Board of Supervisors hereby determines that the County shall make the community remittances set forth in Health and Safety Code section 34194 et seq., subject to any appeal to which the County is entitled under Health and Safety Code section 34194(b)(2)(L)(i).

(c)

County shall not make any community remittance in the event a court of competent jurisdiction either grants a stay on the enforcement of AB 1X 26 and AB 1X 27 or determines that AB 1X 26 and AB 1X 27 are unconstitutional and therefore invalid, and all appeals therefrom are exhausted or unsuccessful, or time for filing an appeal therefrom has lapsed. Any community remittance shall be made under protest and without prejudice to the County's right to recover such amount and interest thereon in the event that there is a final determination that AB 1X 26 and AB 1X 27 are unconstitutional. If there is a final determination that AB 1X 26 and AB 1X 27 are invalid, this section shall be deemed to be null and void and of no further force or effect.

(d)

The Board of Supervisors hereby authorizes and directs the County Executive Officer, or designee to take any action and execute any documents necessary to implement this section, including but not limited to notifying the County Auditor-Controller, the Controller of the State of California, and the California Department of Finance of the adoption of this section and the County's agreement to comply with the provisions of Part 1.9 of Division 24 of the Health and Safety Code, as set forth in AB 1X 27.

(e)

It is the understanding and intent of the Board of Supervisors that, once the Agency is again authorized to enter into agreements under the CRL, the County will enter into an agreement with the Agency as authorized pursuant to Section 34194.2, whereby the Agency will transfer annual portions of its tax increment to the County in amounts not to exceed the annual community remittance payments to enable the County, directly or indirectly, to make the annual remittance payments. The Board of Supervisors does not intend, by enactment of this section, to pledge any of its general fund revenues or assets to make the remittance payments.

(f)

The Board of Supervisors finds, under Title 14 of the California Code of Regulations, Section 15378(b)(4), that this Ordinance is exempt from the requirements of the California Environmental Quality Act ("CEQA") in that it is not a "project," but instead consists of the creation and continuation of a governmental funding mechanism for potential future projects and programs, and does not commit funds to any specific project or program. The Board of Supervisors, therefore, directs that a Notice of Exemption be filed with the County Clerk in accordance with CEQA Guidelines.

(g)

The documents and materials that constitute the record of proceedings on which these findings are based are located at the County Clerk's office. The custodian for these records is the County Clerk.

(h)

If any provision of this section or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this section which can be given effect without the invalid provision or application, and to this end the provisions of this section are severable. The Board of Supervisors hereby declares that it would have adopted this section irrespective of the invalidity of any particular portion thereof.

(a)

No person shall serve more than two (2) consecutive four-year terms as a member of the Board of Supervisors regardless of Supervisorial District represented.

(b)

The limitation contained in subsection (a) shall only apply to service for consecutive terms. No other limitation on the number of terms a person may serve is intended.

(c)

As required by Government Code section 25000(b), this term limit provision shall apply prospectively only, to terms commencing on or after January 1, 1997.

(a)

This section applies when a vacancy occurs in the office of Supervisor requiring a special election pursuant to the County Charter (adopted by the voters as Measure V on March 5, 2002) and is intended to implement Measure V.

The authority of the Board of Supervisors to call a special election and, as permitted by the County Charter, to consolidate the special election with a regularly scheduled election held throughout the supervisorial district with the vacancy, is delegated to the Chair of the Board of Supervisors, and in the event of the Chair's unavailability, to the Vice-Chair, subject to ratification by the Board of Supervisors.

In all such special elections, except for any special election that has been consolidated with a regularly scheduled election pursuant to County Charter, article I, section 103.A., the following timelines shall apply:

(a)

Upon occurrence of a vacancy in the office of the Board of Supervisors, a special election shall be called within three (3) business days to be held on a Tuesday not less than fifty-six (56) days nor more than seventy (70) days after the vacancy occurs.

(b)

Commencing at 8:00 a.m. on the next business day after the call of the election, candidates for the vacant office of supervisor may obtain declarations of candidacy, nomination papers, in-lieu-filing-fee petitions and candidates' statements. All such documents shall be filed with the County Registrar of Voters no later than 5:00 p.m. on the 43rd day prior to the election.

The California Elections Code, to the extent it is applicable, shall govern all other aspects of any special election held pursuant to this section.
