Article 8 — PROBATION DEPARTMENT

(a)

Establishment of Juvenile Home: There are hereby created and established pursuant to the provisions of sections 880 and 891, inclusive, of the Welfare and Institutions Code, juvenile homes, which shall be known as the Joplin Youth Center, located in the vicinity of Trabuco Canyon and the Youth Guidance Center, located in the City of Orange.

(b)

Establishment of Youth Correctional Center: There is hereby created and established pursuant to the provisions of sections 1850 through 1861, inclusive, of the Welfare and Institutions Code, a youth correctional center, which shall be known as Los Pinos Conservation Camp, located in the Cleveland National Forest in the vicinity of the Ortega Highway.

(c)

Management and control: The internal affairs of said juvenile homes and conservation camp shall be under the management and control of the Chief Probation Officer, who may delegate the day-to-day operations to directors selected by him. The directors and employees of the juvenile homes shall be subject to confirmation by this Board of Supervisors as provided in Welfare and Institutions Code section 882.

(d)

Employment of Personnel: The employment of all other personnel at such homes shall be subject to this Code, ordinances and rules and regulations of the County of Orange relating to the employment of County employees, and shall be selected and appointed by the Chief Probation Officer, subject to confirmation by the Board of Supervisors.

(e)

Labor by Wards May Be Required: The wards committed to the juvenile homes and conservation camp may be required to labor on the buildings and grounds thereof, or to perform any other work or engage in any studies or activities prescribed by the Probation Department.

(f)

Public School: The County Superintendent of Schools shall establish and maintain public schools at the juvenile homes and conservation camp established hereunder of such grade or grades as may be, in the judgment of the County Superintendent of Schools, necessary.

Establishment of public schools: The County Superintendent of Schools of Orange County is hereby directed to maintain public schools in the Juvenile Hall and Juvenile Hall Annex of such grade or grades as may be, in the judgment of the County Superintendent of Schools, necessary.

(a)

Establishment of Juvenile Home. There is hereby created and established pursuant to provisions of sections 880 and 891, inclusive, of the Welfare and Institutions Code a juvenile home in and for the County of Orange, State of California, which shall be maintained at the following locations:

(1)

Such portion of the buildings and grounds located at 331 City Drive South, Orange, California, as may be designated as a juvenile home by the Probation Officer.

(2)

On the site bordered on the north by the Santa Ana Freeway, on the east by Bristol Street, on the south by the Garden Grove Freeway and on the west by the Santa Ana River.

(3)

1207 Fruit Street, Santa Ana, California.

(b)

Homes Named: Facilities described in subsection (a)(1) located at 331 City Drive South, Orange, California, as may be designated a juvenile home by the Probation Officer shall be known as the Family Guidance Program. The facilities described in subsection (a)(2) shall be known as the Youth Guidance Center. The facilities described in subsection (a)(3) located at 1207 Fruit Street shall be known as the David R. McMillan School.

(c)

Management and Control: The internal affairs of said home shall be under the management and control of the Probation Department and said home shall be in the charge of a Director who shall be selected and appointed by the Chief Probation Officer, subject to this Code, ordinances and rules and regulations of the County of Orange relating to the employment of County employees, and subject to confirmation of the Board of Supervisors.

Employment of Personnel: The employment of all other personnel at such home shall be subject to this Code, ordinances and rules and regulations of the County of Orange relating to the employment of County employees, and shall be selected and appointed by the Chief Probation Officer, subject to confirmation by the Board of Supervisors.

(e)

Penal Code Section 1208 To Be Operative: The Board of Supervisors of the County of Orange finds that, on the basis of employment and educational conditions, the lack of suitable places for confinement of persons within existing county detention facilities, and other pertinent circumstances, that the operation of a Work Furlough Program pursuant to Penal Code Section 1208 is feasible and shall continue in effect; that in addition to County Jail, the Community Furlough Facility is hereby designated for confinement of persons classified for the Work Furlough program. The Probation Officer of this County is designated as the Work Furlough Administrator and Custodian of the Community Furlough Facility. Any contracts entered into by the Work Furlough Administration pursuant hereto shall specify the location of the facility and shall set forth all terms and conditions for the provision of services and the contract shall be filed with the Clerk of the Board upon execution thereof.

(a)

Costs of Probation: Pursuant to section 1203.1b of the California Penal Code, Orange County Courts are hereby authorized to impose upon defendants as a condition of probation a requirement that said defendants pay the cost of probation services, said costs not to exceed the monthly amount determined to be the actual average cost of probation services.

(b)

Costs of Reports: Pursuant to section 1203.1b of the California Penal Code, Orange County Courts are hereby authorized to impose upon a defendant as a condition of probation a requirement that said defendant reimburse the County for the cost of conducting pre-sentence, pre-plea, or conditional sentence investigations and preparing pre-sentence, pre-plea, or conditional sentence reports rendered to the Court pursuant to section 1203 of the Penal Code.

(c)

Allocation: All sums paid by defendants pursuant to subsections (a) and (b) for costs of probation services and costs of conducting investigations and providing reports shall be allocated for the operating expenses of the Orange County Probation Department.

(d)

Installment Fee: Pursuant to Section 1203.1b(h) of the California Penal Code, the Board of Supervisors may, by resolution, establish a fee for the processing of payments made in installments.

(a)

Costs of Incarceration: Pursuant to section 1203.1c of the California Penal Code, Orange County Courts are hereby authorized to impose upon defendants as a condition of probation a requirement that said defendants pay the cost of their incarceration, including incarceration pending disposition of the case based upon the defendants ability to pay and not to exceed the average cost per day, costs to be determined on an annual basis by the Board of Supervisors and reviewed on an annual basis, said costs reimbursement being for the purpose of meeting operating expenses, including but not limited to employee wage rates and fringe benefits.

(b)

Collecting Officer: Pursuant to section 1203.1c of the Penal Code, the Board of Supervisors designates the Chief Probation Officer as the county officer to collect fees under this section.

(c)

Determination of Costs: Pursuant to section 1203.1c of the Penal Code, the Board determines that the existing fee of twenty-five dollars and thirty cents ($25.30) per day is for the purpose of meeting operating expenses, including but not limited to employee wage rates and fringe benefits, that said fee does not exceed cost, and that said fee shall be updated annually by the Auditor-Controller and approved by the Board of Supervisors by resolution or minute order.
