Article 9 — PRIVATELY OWNED PARKS

Sec. 2-5-200. - Reserved.

Sec. 2-5-201. - Scope.

(a)

The provisions of this article 9 of division 5 of title 2 are enacted by the Board of Supervisors of the County of Orange, and shall, unless otherwise expressly provided, apply in all privately owned parks with respect to which all of the following has occurred:

(1)

The County has received an irrevocable offer of dedication of the park to the County;

(2)

The County has declined said offer of dedication, or has not accepted said offer of dedication within one hundred twenty (120) days of receipt of said offer of dedication;

(3)

All the consenting owners of the park have consented in writing to application of this article in the park and have recommended in writing hours for the park to be open and a speed limit(s) for parking areas, roadways and streets within the park, if any;

(4)

The Sheriff-Coroner has given approval in writing to the application of this article in the park and has recommended in writing hours for the park to be open and a speed limit(s) for parking areas, roadways and streets within the park, if any;

(5)

The Board of Supervisors, by resolution, has designated the park as an area in which the provisions of this article will apply and has established hours during which the park will be open and a speed limit(s) for parking areas, roadways and streets within the park, if any; and

(6)

At every entrance to the park, a consenting owner or operator has caused to be posted a prominent sign reading, "The provisions of Article 9 of Division 5 of Title 2 of the Codified Ordinances of the County of Orange will be enforced in this park." Said signs also shall display prominently the hours the park is open, as said hours were established by the Board of Supervisors by resolution.

(b)

If, at any time, the Board of Supervisors determines that the application of this article to any park in which this article applies no longer is necessary or is not in the best interests of the County of Orange, the application of this article in said park may be terminated by resolution of the Board of Supervisors.

(c)

A consenting owner may withdraw consent to the application of this article in any park to which this article applies. Such withdrawal of consent shall be communicated in writing, by certified mail, to the Clerk of the Board of Supervisors. Upon receipt, the Clerk of the Board of Supervisors shall immediately transmit to each member of the Board of Supervisors, the Sheriff-Coroner and the District Attorney a copy of the withdrawal of consent. This article, in its entirety, shall become inapplicable in said park thirty (30) days after receipt by the Clerk of the Board of Supervisors of the consenting owner's written withdrawal of consent. When this article becomes inapplicable in a park as a result of withdrawal of a consenting owner's consent, said consenting owner shall immediately cause to be removed all signs that were posted in accordance with this article.

(d)

The provisions of this article shall not be enforced so as to impair the lawful exercise of recorded property rights of an owner.

Sec. 2-5-202. - Definitions.

Notwithstanding section 2-5-2, for the purposes of this article only the following terms shall have the respective meanings set forth herein, unless the context in which they are used clearly indicates to the contrary:

Camp paraphernalia: Includes, but is not limited to, tarpaulins, cots, beds, sleeping bags, hammocks or non-designated cooking facilities and similar equipment.

Consenting owner: An owner of a fee simple interest in real property comprising a designated park or an owner of any other real property interest in a designated park whose interest the Board of Supervisors has determined, by resolution, will be materially impaired by enforcement of this article in a designated park, or a successor in interest to a consenting owner.

Designated park: A park to which this article has been made applicable in accordance with section 2-5- 201.

Eviction: Expulsion from a designated park.

Owner: A person owning a real property interest in a designated park.

Operator: A person or persons designated in writing by a consenting owner of a designated park to perform the duties and to exercise the rights that this article requires to be performed or permits to be exercised by a consenting owner or operator.

Park: A park, playground, roadside rest, riding trail, hiking trail, bicycle trail, green belt or public recreation facility.

Park waters: Any lake, reservoir, pond, wetland, river, stream, creek, wash, vernal pool or other perennial or seasonal body of water within or flowing through a designated park.

Wildlife: Any terrestrial, aquatic or marine mammal, bird, reptile, amphibian, fish, mollusk, arthropod or any other vertebrate or invertebrate member of the animal kingdom, including a part, product, egg or offspring thereof.

Sec. 2-5-203. - Effect, enforcement, and penalties.

(a)

Conditioned Use of Designated Park. The privilege of any person to use a designated park is hereby expressly conditioned upon compliance by that person with the provisions of this article as they apply to such use.

(b)

Eviction. In addition to other penalties provided for in the Codified Ordinances of the County of Orange, violation of any provision of this article shall subject the violator to eviction from the designated park in which the violation occurs, in accordance with the procedures in section 2-5-220. This article shall be enforced by peace officers having jurisdiction of any area in which a violation of any provision of this article may take place.

(c)

Penalties. In unison with section 1-1-34, General penalties, any person convicted of violating a section of this article within a designated park shall be guilty of a misdemeanor, except as otherwise provided herein. At the discretion of the District Attorney, prosecution of a complaint filed in violation of any section of this article that is designated as a misdemeanor may be reduced to an infraction.

Sec. 2-5-204. - Purpose.

The purpose of this article is to provide for the orderly use and control of designated parks within the County of Orange so as to achieve the maximum safety and benefit to the public.

Sec. 2-5-205. - Amendments.

The Board of Supervisors may amend this article at any time. Any such amendment shall become applicable in all previously or subsequently designated parks, unless a Consenting Owner of a previously designated park withdraws consent to application of this article in said park.

Sec. 2-5-215. - Hours.

All designated parks shall be open to the public during such hours as may be established by resolution of the Board of Supervisors. No person shall enter or remain in a designated park at any time other than during such hours as the designated park is open to the public.

Sec. 2-5-218. - Electric outlets.

No person shall use electric outlets within a designated park without first obtaining approval by a consenting owner or operator.

Sec. 2-5-220. - Eviction.

(a)

A person is subject to eviction from a designated park when the following conditions occur:

(1)

The person is in violation of any provision of this article;

(2)

The person has been warned in a manner that is reasonably calculated to reach that person that eviction may result from any further violation;

(3)

After receiving such warning, a further violation occurs;

(4)

No lesser sanction reasonably appears to suffice; or

(5)

Following a warning, the violation continues unabated regardless of the person's subsequent action.

However, where a violation is of such magnitude or seriousness as to create a clear and present danger of imminent violence, no warnings will be necessary prior to eviction.

(b)

A group is subject to eviction from a designated park when any one of the following conditions occur and no lesser sanction reasonably appears to suffice:

(1)

There is probable cause to believe that an unlawful assembly exists pursuant to California Penal Code section 407;

(2)

There is a clear and present danger of imminent violence which cannot reasonably be forestalled without evicting the entire group;

(3)

There are multiple individual violations of a provision or provisions of this article which have not stopped following the eviction of one (1) or more such individual violators, and violations continue after the group has had a reasonable opportunity to cure them.

(c)

No person or group evicted from a designated park shall remain in or return to the facility prior to the expiration of the eviction period, a minimum of 24 hours.

Secs. 2-5-221—2-5-226. - Reserved.

Sec. 2-5-227. - Protection of natural, cultural, structural, and archaeological resources.

(a)

Plants. No person shall possess, destroy, injure, deface, remove, dig, or disturb from its natural state any plant or the parts or products thereof in any designated park except as otherwise provided herein.

(b)

Wildlife. No person shall possess, destroy, injure, deface, remove, dig, or disturb from its natural state any living or dead wildlife, or the parts or products thereof, such as antlers, shells, bones or nests, in any designated park, except as otherwise provided herein. No person shall introduce any wildlife or plant, including their reproductive bodies, into any designated park.

(c)

Artifacts. No person shall possess, destroy, injure, deface, remove, dig, or disturb from its natural state any fossilized or nonfossilized paleontological specimens, cultural or archaeological resources, or the parts thereof in any designated park.

(d)

Minerals. No person shall possess, destroy, injure, deface, remove, dig, or disturb from its natural state any rock, mineral, geological formation or cave formation or the parts thereof in any designated park.

(e)

Landscape Structures. No person shall walk on, climb, enter, ascend, descend, or traverse an archaeological resource, monument, or statue, in any designated park, except in areas and under conditions designated by a consenting owner or operator. No person shall possess, destroy, injure, deface, remove, dig, or disturb any historic structure or its furniture or fixtures, or any other cultural or archaeological resource in any designated park.

(f)

Improvements. No person shall possess, destroy, injure, deface, remove, dig or disturb any improvement or amenity, or any fence or gate, or any structure or its furniture or fixtures in any designated park.

(g)

Wood. No person shall collect, use or possess any wood gathered within any designated park, except in an area designated and under conditions established by a consenting owner or operator for the gathering of fuel wood for campfires or barbecues. Any person convicted of violating this subsection shall be guilty of an infraction.

(h)

Natural Products. No person shall gather, collect or possess natural products in any designated park, except in areas and under conditions designated by a consenting owner or operator. Any person convicted of violating this subsection shall be guilty of an infraction.

Sec. 2-5-228. - Sanitation.

(a)

Use of Rubbish Receptacles. No person shall leave, deposit, drop or scatter any bottles, broken glass, ashes, wastepaper, cans or other rubbish, garbage, litter, food product, animal feed, refuse or offal matter in or on any designated park except in a designated trash receptacle. No person shall rummage through or remove the contents of any designated trash receptacle except in areas and under conditions designated by a consenting owner or operator. No person shall deposit any such matter in a toilet located in a designated park.

(b)

Washing of Clothes and Utensils. No person shall wash clothing, dishes, cooking utensils or other utensils used in connection with the preparation or serving of food in a designated park except at places designated by a consenting owner or operator and provided for such purpose.

(c)

Cleanliness of Picnic Areas. All persons using a picnic area in a designated park shall keep said area safe, clean and free from rubbish, litter, broken glass, garbage, refuse or offal matter. Combustible rubbish may be burned where fires are permitted, and all other garbage and refuse of any kind shall be placed in containers or pits provided for that purpose.

(d)

Toilets and Refuse. No person shall discharge any human or animal excreta or wastewater from a toilet or holding tank in a designated park. Toilets in designated parks are provided for the protection of the health of the general public and shall be used when so provided.

Sec. 2-5-229. - Vehicle regulation.

(a)

Speed. No person shall operate any vehicle in a designated park at a speed that is greater than is reasonable or prudent, having due regard for the traffic and traffic pattern, pedestrians, bicyclists, and the surface and width of the roadway, streets, trails or parking areas, and in no event shall vehicles operate in excess of ten (10) miles per hour unless a greater speed is posted.

(b)

Parking. No person shall park, stop or leave standing any vehicle, whether attended or unattended, in a designated park except in posted parking areas.

(c)

Erection of Speed, Traffic and Parking Signs. A consenting owner or operator shall cause to be erected and maintained signs at appropriate locations indicating the speed limit(s) in the designated park. A consenting owner or operator also shall designate parking areas and traffic patterns and erect and maintain signs

indicating such areas and patterns. All such signs shall include a reference to this section as follows: "OCCO Sec. 2-5-229."

(d)

Removal of Vehicles. Vehicles may be removed and stored at the vehicle owner's expense by peace officers under any of the following circumstances:

(1)

The vehicle has been parked for a period of time longer than seventy-two (72) hours consecutive hours in any designated park.

(2)

The vehicle has been parked illegally, or in such a way as to create a hazard or disrupt public, private, or emergency access.

(e)

Limited Time Parking Zone. No person shall have any vehicle stopped, parked or left standing, whether attended or unattended, in a limited time parking stall or space for more than the posted time period, if appropriate signs have been posted.

(f)

Unauthorized Motor Vehicles. No person shall operate an unauthorized motor vehicle, including, but not limited to, an automobile, truck, four-wheel drive vehicle, motorcycle, motor bike, motor dirt bike, all-terrain vehicle or off highway vehicle within a designated park, except on roadways and streets and in parking areas.

For the purpose of subsection (f), "unauthorized motor vehicle" means any motorized vehicle that is driven upon said areas without written permission of a Consenting Owner or Operator. This subsection does not apply to the operation of any vehicle by an Owner or the agent of an Owner that is consistent with the Owner's interest in and rights to real property comprising the designated park, nor to the operation of any vehicle by a local, state or federal government agency.

(g)

Vehicle Repair. No person shall repair, dismantle, overhaul or perform any mechanical work upon any type of vehicle, trailer or boat in any designated park, except to replace or otherwise repair a tire or to make emergency repairs to enable such vehicle, trailer or boat to be removed to a proper place.

(h)

Stop Requirements. The driver of any vehicle approaching a stop sign at the entrance to, or within, an intersection, within any designated park shall stop at a limit line, if marked, otherwise before entering the intersection. If there is no limit line, the driver shall stop at the entrance to the intersecting roadway.

(i)

Dumping Prohibited. No person shall place, deposit or dump, or cause to be placed, deposited or dumped, any rocks, refuse, garbage, dirt or similar materials in or upon any designated park, except with the consent of a consenting owner or operator.

(j)

Hours of Operation. No person shall stop, park or leave standing any vehicle, whether attended or unattended, in a designated park at any time other than during established and posted hours of operation.

(k)

Parking Violations. Any person violating subsections (b), (e) or (j) of this section shall be guilty of a parking violation pursuant to Division 17, Chapter 1, Article 3, sections 40200-40230 of the California Vehicle Code.

Sec. 2-5-230. - Skateboards, roller skates and in-line skates.

(a)

Skateboards. No person shall ride a skateboard, including but not limited to scooters and mountain skateboards, or similar conveyances propelled by human power other than a bicycle or cause or permit same to roll or coast in any designated park except in areas and under conditions designated and posted by a consenting owner or operator for such use.

(b)

Roller Skates and In-Line Skates. No person shall ride roller skates, in-line skates, or similar conveyances propelled by human power other than a bicycle or cause or permit it to roll or coast in any designated park where a consenting owner or operator has posted signs to prohibit such activity. No person shall ride roller skates, in-line skates, or similar conveyances on any unpaved trail in a designated park, except in areas and under conditions designated and posted by a consenting owner or operator for such use.

(c)

Signs. A consenting owner or operator may cause signs to be erected and maintained at appropriate locations pursuant to this section. All signs posted in accordance with this section shall include a reference to this section as follows: "OCCO Sec. 2-5-230."

Sec. 2-5-235. - Alcoholic beverages.

No person shall, within the limits of a designated park, possess or consume any alcoholic beverage.

Sec. 2-5-236. - Reserved.

Sec. 2-5-237. - Firearms, weapons, fireworks, replica firearms.

No person shall have any fireworks, firearms, replica firearms, air gun, BB gun, paint ball gun, slingshot or bow or hunting arrow or any weapon in his possession or in his vehicle, other than in a closed trunk, storage compartment or other area separated from the passenger section of the vehicle, in a designated park, nor shall any person discharge any firearm, fireworks or weapon or display any replica firearm upon or into any designated park.

Sec. 2-5-238. - Disturbing or taking wildlife.

No person shall hunt, kill, wound, feed, touch, tease, frighten, or intentionally disturb wildlife in any designated park, except persons in the performance of official duties, or in areas and under conditions designated by a consenting owner or operator.

Sec. 2-5-239. - Controlling domestic animals.

(a)

Leash Required. No person shall allow a dog, cat or other domestic animal in any designated park unless the animal is restrained at all times by a substantial leash not to exceed six (6) feet in length and in the control of a person competent to restrain the animal, or unless the animal is restrained and enclosed in a cage, crate or similar enclosure.

(b)

Unattended Animal. No person shall leave an animal unattended and tied to an object or confined in a vehicle in any designated park. Any person convicted of violating this subsection shall be guilty of an infraction.

(c)

Animal Wastes. All persons shall remove and properly dispose of animal excreta from any designated park. Any person convicted of violating this subsection shall be guilty of an infraction.

(d)

Designated Areas. No person shall allow a dog, cat or other domestic animal, other than a guide animal, service animal or signal animal accompanying a disabled person, in any designated park, except in areas and under conditions designated and posted by a consenting owner or operator. A consenting owner or operator may cause signs pursuant to this subsection to be erected and maintained at appropriate locations. All such signs shall include a reference to this subsection as follows: "OCCO Sec. 2-5-239(d)."

(e)

Feral Animals. Any peace officer may authorize the impoundment of any at-large, feral or otherwise unattended or unrestrained domestic animal from a designated park by an animal control officer or other

qualified agent. The owner of an impounded animal is responsible for any and all fees, penalties or other costs associated with the impoundment.

(f)

Dog Shows. Nothing in this section shall prevent a consenting owner or operator from holding or permitting supervised public events in a designated park in which domestic animals participate or group activities wherein dogs are under the responsible care of a person while not restrained by a leash or enclosed in a car, cage or similar enclosure while participating in a canine event.

(g)

Domestic Animals in Park Waters. No person shall allow a dog, cat, or other domestic animal in any park waters.

Sec. 2-5-240. - Research specimens; permit required.

No person shall collect plants, wildlife, rocks, minerals, paleontological specimens or cultural or archaeological artifacts in any designated park except with the permission of a consenting owner or operator or in performance of official duties. No person may possess, carry or use any trap, live trap, snare, net, kill jar or similar device in a designated park except with the permission of a consenting owner or operator or in performance of official duties.

Sec. 2-5-241. - Rock climbing.

(a)

Climbing. No person shall ascend, descend or traverse, including aid climb, free climb, solo climb, or rappel, from any rock formation or structure in a designated park except persons in the performance of their official duties.

(b)

Bolts. No person shall place or cause to be placed any permanent or temporary climbing protection, including but not limited to bolts, hangers, chocks, bongs, cams, or friends, in a designated park area except persons in the performance of their official duties.

Sec. 2-5-242. - Radio-controlled models.

No person shall possess or operate any radio-controlled or other remotely operated model, toy or similar device, including but not limited to cars, boats, rockets, airplanes or gliders, in any designated park, except in areas and under conditions designated and posted by a consenting owner or operator. A consenting owner or operator may cause signs pursuant to this section to be erected and maintained at appropriate locations. All such signs shall include a reference to this section as follows: "OCCO Sec. 2-5-242."

Any person convicted of violating this subsection shall be guilty of an infraction.

Sec. 2-5-243. - Bicycles.

(a)

Unsafe Operation. No person shall operate a bicycle in any manner that endangers any person or animal or at a speed that is greater than is reasonable or prudent, having due regard for other users and the surface, width, and grade of the road or trail, and in no event in excess of ten (10) miles per hour, unless a greater speed is posted.

(b)

Bicycle Parking. No person shall leave a bicycle lying on its side on a road or trail in a designated park in such a way as to obstruct pedestrian, equestrian, or vehicle traffic. Any person convicted of violating this subsection shall be guilty of an infraction.

(c)

Helmets. No person under eighteen (18) years of age shall operate a bicycle, or ride upon a bicycle as a passenger on any road, bikeway or trail in any designated park unless that person is wearing a properly fitted and fastened bicycle helmet. The bicycle helmet must meet the standards pursuant to section 21212 of the California Vehicle Code. Any person convicted of violating this subsection shall be guilty of an infraction.

Sec. 2-5-244. - Powerless flight.

No person shall operate any device designed to carry a person or persons through the air in powerless flight, including but not limited to hang gliders, paragliders, parasails, or parachutes, in a designated park.

Sec. 2-5-245. - Athletic activities.

No person shall conduct or participate in any sport or in any organized athletic activities within a designated park other than in such areas as may be designated for such sports, games or athletic activities, nor in any areas where signs prohibiting such activities are posted. A consenting owner or operator may cause signs pursuant to this section to be erected and maintained at appropriate locations. All such signs shall include a reference to this section as follows: "OCCO Sec. 2-5-245."

Sec. 2-5-246. - Trails and closed areas.

(a)

Designation and Use. A consenting owner or operator may designate horseback riding and hiking trails in a designated park. A consenting owner or operator may also designate closed areas where entry is prohibited in the interest of public convenience or safety. No person may leave a designated trail in any designated park on foot, or on horseback or otherwise, other than for law enforcement, lifesaving or emergency purposes or for park maintenance, at other than designated entry or exit points. No person shall enter on foot, or horseback or otherwise, any areas in a designated park which a consenting owner or operator has caused to be posted as a closed area. All signs designating horseback riding and hiking trails and closed areas shall reference this subsection as follows: "OCCO Sec. 2-5-246(a)."

(b)

Gates. No person opening a closed gate in a designated park shall proceed beyond said gate without first closing it.

Sec. 2-5-247. - Livestock and horses.

(a)

Saddle and Pack Animals. No person having custody or control of a horse or other saddle or pack animal shall allow said animal in any part of a designated park except upon roads or bridle trails designated for equestrian traffic. No person shall ride or drive any horse or other animal which is not well broken and under the control of said person. No person shall ride any saddle animal in any manner that endangers any other person or animal. No person shall allow his saddle or pack animal to stand unattended or improperly tied.

(b)

Livestock. No person shall molest livestock in or adjacent to a designated park.

(c)

Loose Herding. No person shall free-trail or loose-herd horses or other pack or saddle stock in any designated park.

Sec. 2-5-248. - Construction.

No person shall erect structures within any designated without the consent of a consenting owner or operator and subject to applicable permits and building codes.

Sec. 2-5-249. - Diving/jumping.

No person shall dive or jump into any body of water in a designated park from any pier, bridge, rock or precipice other than at those places designated and posted for diving or jumping by a consenting owner or operator. Violation of this section shall be an infraction.

Sec. 2-5-250. - False drowning alarm.

No person shall give or cause a false alarm of a drowning in a designated park to be given in any manner. Any person who knows that an alarm is false shall immediately notify the person or persons to whom said alarm was given of its falsity.

Sec. 2-5-251. - Equipment removal.

No person shall allow any equipment over which he or she has custody or control to remain at a designated park during any time that said designated park is closed.

Sec. 2-5-263. - Fishing.

(a)

Designated Waters. No person shall fish or practice casting, including but not limited to fly casting, in any designated park except in areas and under conditions designated by a consenting owner or operator. A consenting owner or operator may cause signs pursuant to this subsection to be erected and maintained at appropriate locations. All such signs shall include a reference to this subsection as follows: "OCCO Sec. 2- 5-263(a)."

(b)

Method of Take. No person shall fish in any park waters in any manner other than by one (1) rod and line or one (1) handline, with the rod or line closely attended, except in areas and under conditions designated by a consenting owner or operator and in accordance with State law. No person shall use a line with more than one (1) hook or with one (1) artificial lure with no more than three (3) hooks integral to the lure. No person shall fish by the use of drugs, poison, explosives, or electricity in park waters except persons in the performance of their official duties. No person shall fish by use of net, spear or weapon in park waters except in areas and under conditions designated by a consenting owner or operator and in accordance with state law. A consenting owner or operator may cause signs pursuant to this subsection to be erected and maintained at appropriate locations. All such signs shall include a reference to this subsection as follows: "OCCO Sec. 2-5-263(b)."

(c)

Bait Restrictions. No person shall use live or dead minnows or other bait fish, amphibians, arthropods, or nonpreserved fish eggs or fish roe in a designated park, except in park waters designated by a consenting owner or operator. No person shall dig for or otherwise gather bait within a designated park except in areas and under conditions designated by a consenting owner or operator. A consenting owner or operator may cause signs pursuant to this subsection to be erected and maintained at appropriate locations. All such signs shall include a reference to this subsection as follows: "OCCO Sec. 2-5-263(c)."

(d)

Inspection. Any peace officer may check fishing licenses and inspect creels, tackle, and fishing gear for compliance with the provisions of this section.

Sec. 2-5-264. - Swimming.

No person shall swim, bathe, wade or otherwise enter in or into waters of a designated park other than those waters designated and posted by a consenting owner or operator for such swimming, bathing, wading or entering. All signs designating swimming, bathing and wading areas shall reference this section as follows: "OCCO Sec. 2-5-264."

Sec. 2-5-265. - Fire regulation.

(a)

Campfire Location. No person shall build, light or maintain any fire in a designated park except in a camp stove, fire ring, barbecue or fireplace provided in areas designated by a consenting owner or operator for such purposes; provided, however, that camper, trailer, oil or gas camp stoves and braziers or hibachis may be used in areas designated for their use by a consenting owner or operator. No consenting owner or operator may permit fires in any area within a designated park that is restricted by state and local fire prevention officials.

(b)

Removal of Combustible Materials. No person shall build a campfire in a designated park until he has first cleared an area of twenty-five (25) feet in all directions from said campfire site of all deadwood, moss, dry leaves or other combustible material.

(c)

Extinguishing Fires. Each person building or using a campfire, fire ring, barbecue, or fireplace in a designated park shall, when said campfire, fire ring, barbecue or fireplace is no longer needed, extinguish said campfire, fire ring, barbecue or fireplace by thoroughly wetting and stirring the combustible material and covering it with sand or dirt.

(d)

Fire Prevention. Every person shall make the suppression and prevention of fire their first consideration while using a designated park area. Any negligent use of combustible materials is prohibited. Any person learning of an unauthorized fire in a designated park shall extinguish it if he can do so without endangering himself, or, if he cannot extinguish it, shall promptly communicate the position of the fire to emergency personnel or a consenting owner or operator.

(e)

Smoking. A consenting owner or operator may restrict or prohibit smoking in all or any part of a designated park. In such cases the consenting owner or operator shall post smoking regulations at conspicuous locations. All signs pertaining to such smoking regulations shall reference this subsection as follows: "OCCO Sec. 2-5-265(e)." No person shall smoke in a designed park in violation of such regulations.

Sec. 2-5-295. - Unauthorized camping.

It shall be unlawful for any person to camp, occupy camp facilities, use camp paraphernalia, or store personal property in a designated park except in an area and under conditions, designated by a consenting owner or operator.
