§ 5-20

Sec. 5-20.01. Definitions.

(a) As used in this chapter, “picture arcade” shall mean any place to which the public is admitted wherein one (1) or more film- or video-viewing devices are maintained. (b) As used in this chapter, “film- or video-viewing device” shall mean any electrical or mechanical device which projects or displays any film or video tape or reproduction, the temporary use of which is contingent upon the payment of some consideration. (c) As used in this chapter, “person” shall include an individual, firm, partnership, joint venture, association, estate, trust, receiver or a syndicate. (d) As used in this chapter, “viewing area” shall mean the area where a patron or customer would ordinarily be positioned while watching a film- or video-viewing device. (§ 1, Ord. 2253, eff. Sec. 5-20.02. Interior design requirements.

No person, either as owner or lessee, or as employee, agent, director, or officer of owner or lessee, shall operate or maintain any picture arcade unless all viewing areas are visible from a continuous viewing aisle and are not obscured by any curtain, door, wall or other enclosure. Sec. 5-20.03. Violations: Misdemeanors.

Any person violating any of the provisions of § 5-20.02 of this Code shall be guilty of a misdemeanor. (§ 1, Ord. 2253, eff. December 1, 1983)

Sec. 5-20.04. Existing picture arcades: Compliance date.

Picture arcades which were lawfully in existence in the City on October 21, 1986, shall have until March 1, 1987, to be brought into compliance with the interior design requirements of § 5-20.02 of this Code.
