For the purposes of this chapter, “garage or yard sale” shall mean any event where items of personal property owned, utilized, or maintained by the occupants of the premises, other than a licensed commercial business, are to be offered for sale to the general public. This shall include garage, patio, and other similarly conducted sales. The term “garage or yard sale” does not include rummage sales by non-profit organizations licensed to do business in the City which obtain a temporary use permit as required by Title 9, Chapter 1, Article 11 of the Ontario Municipal Code. (a) The frequency of garage or yard sales in the City shall be limited to no more than four (4) weekends per calendar year. The Council may by resolution declare the four (4) weekends in which garage or yard sales may be conducted, and may consider such factors as inclement weather or garage or yard sale weekends of neighboring cities, among any other factors the Council deems relevant. For purposes of this subsection, the term weekend shall mean Friday, Saturday, and Sunday. (b) Garage or yard sales shall be conducted only between the hours of 7:00 a.m. and 6:00 p.m. (§ 1, Ord. 1770, eff. December 16, 1971, as amended by Ord. 2063, eff. One double-faced sign, not to exceed six (6) square feet in area on any one side, shall be permitted on the property where such sale is located. Such sign may be posted only on the days of the sale. (§ 1, Ord. 1770, eff. December 16, 1971)

The provisions of this chapter shall not apply to sales of personal property made under court order or process. (§ 1, Ord. 1770, eff. December 16, 1971)

All personal property to be sold shall be arranged so that fire, police, health, and other officials may have access at all times during the sale. Enforcement of the provisions of this chapter shall be by the Police Department and all officers of the City charged with the enforcement of laws. (§ 1, Ord. 1770, eff. December 16, 1971)

Only the seller’s personal property may be sold at a garage or yard sale. New merchandise, or items acquired consigned for the purpose of resale, may not be sold at a garage or yard sale. (§ 4, Ord. 2924, eff. June 17, 2010)

Garage or yard sales, as defined in this chapter, are only allowed on properties owned and permitted for residential use. (§ 5, Ord. 2924, eff. June 17, 2010)
