Chapter 2 — TRAFFIC

This chapter may be cited as the "Ojai Uniform Traffic Law." (§ 1, Ord. 649, eff. September 24, 1987)

The Vehicle Code, as now or hereafter constituted, is hereby adopted by the City, and a violation of said statute shall be an offense against the City.

The provisions of the Vehicle Code and this chapter shall be applicable to the following:

• (a) All streets and highways;

• (b) Those driveways, paths, roads, parking facilities, and grounds owned, operated, or controlled by the City as determined by the Director of Public Works; and

• (c) Those privately-owned and maintained roads and parking facilities as determined and designated by the Council by resolution according to the provisions of the Vehicle Code and City policy and when signs giving notice thereof have been erected.

Whenever the provisions of this chapter establish regulations applicable to a portion of a State highway or delegate to a City official authority for the administration and enforcement of regulations applicable to a portion of a State highway, such regulations shall have been submitted to the Department of Transportation of the State in draft form for approval prior to enactment pursuant to Sections 21104, 21353, 22501, 22506, 35702, and other applicable sections of the Vehicle Code.

Article 2 Definitions

For the purposes of this title, unless otherwise apparent from the context, certain words and phrases used in this title are defined as set forth in this article.

Whenever any words or phrases used in this title are not defined in this chapter but are defined in the Vehicle Code, such definitions shall be incorporated in this title and shall be deemed to apply to such words and phrases in this title as though set forth in this title in full. "City" shall mean the City of Ojai, California. (§ 1, Ord. 649, eff. September 24, 1987)

"Loading zone" shall mean the space adjacent to a curb reserved for the exclusive use of vehicles during the loading or unloading of passengers or materials. (§ 1, Ord. 649, eff. September 24, 1987)

"Local street" shall mean any street or highway in the City other than a State highway. (§ 1, Ord. 649, eff. September 24, 1987)

"State highway" shall mean those portions of Route 33 and Route 150 located within the City. (§ 1, Ord. 649, eff. September 24, 1987)

"Vehicle Code" shall mean the Vehicle Code of the State.

Article 3 Administration

Subject to State laws, the Council shall exercise all municipal traffic authority for the City, except those powers specifically and expressly delegated in this title or by another ordinance. (§ 1, Ord. 649, eff. September 24, 1987)

The Director of Public Works shall place and maintain, or cause to be placed and maintained, all official traffic control devices where, in the opinion of the Director of Public Works, such official traffic control devices are necessary to protect the public safety. It shall be the duty of the officers of the Police Department, or such officers as are assigned by the Chief of Police, to enforce all street traffic laws of the City. (§ 1, Ord. 649, eff. September 24, 1987)
