Article 14 — Displaying Vehicles for Sale

§ 3-2.1401. Prohibitions on advertising vehicles for sale.

Except as otherwise provided in this article, no person shall park any vehicle on any public or private property for the purpose of displaying, advertising, or offering such vehicle for sale. (§ 1, Ord. 649, eff. September 24, 1987)

§ 3-2.1402. Prohibitions on advertising vehicles for sale: Exceptions.

The provisions of Section 3-2.1401 of this article shall not apply to the following:

  • (a) Any person parking no more than one vehicle at a time for the purposes specified in Section 3-2.1401 of this article on property in which such person has an estate or right of possession or on the property of another with the written consent of the owner, lessee, or person in lawful possession of such property where them is no more than one vehicle so parked and displayed at any one time on such property;

  • (b) Any person licensed pursuant to the provisions of Chapter 3 (commencing with Section 11500) or Chapter 4 (commencing with Section 11700) of Division 5 of the Vehicle Code and operating at a place of business where such business is permitted by the zoning laws of the City; or

  • (c) Any person parking any vehicle for the purposes specified in Section 3-2.1401 of this article on property which is the established place of business of a person licensed as specified in subsection (b) of this section, so long as the person parking the vehicle has the consent of the person so licensed.

Article 15 Bicycle Licenses

§ 3-2.1501. Licenses required.

Pursuant to Section 21206 of the Vehicle Code, no resident of the City shall operate a bicycle on any street, road, highway, or other public property within the jurisdiction of the City unless such bicycle is licensed in accordance with the provisions of this article. § 3-2.1502. Licenses: Issuance.

Each person engaged in the business of selling bicycles within the City (referred to in this article as a bicycle retailer) shall issue and affix the license required by this chapter for each bicycle sold by him or her and for each person applying for such a license. Such bicycle retailers shall obtain such information as is required on forms furnished by the City and shall comply with all procedural requirements of the City or as required by State laws. The license, when affixed, shall be securely attached to the bicycle so as to be visible from the rear and at all times shall be maintained in good condition and in such position of visibility, except during periods of repair. Each bicycle retailer shall be entitled to retain fifty (50) cents from the license fee for each license issued and twenty-five (25) cents from the transfer fee for each license transferred. Licenses may also be issued and transferred by the Police Department. (§ 1, Ord. 649, eff. September 24, 1987)

§ 3-2.1503. Licenses: Fees.

The annual license fee shall be one dollar ($1.00). All revenues from such fees shall be used to improve bicycle safety programs and establish bicycle facilities in the City. (§ 1, Ord. 649, eff. September 24, 1987)

§ 3-2.1504. Transfer of ownership.

  • (a) Each owner of a bicycle licensed pursuant to the provisions of this article shall notify the Police Department within 10 days after the ownership of such bicycle has been transferred. The notification may be made orally and shall include his name, the license number, the date of transfer, and the name and address of the transferee.

  • (b) Each resident of the City who acquires ownership of a bicycle licensed pursuant to the provisions of this article shall apply, within 10 days after such acquisition, for the transfer of such license to his name and furnish the information and fees required for such transfer.

§ 3-2.1505. Change of address.

Whenever the owner of a bicycle licensed pursuant to the provisions of this article changes his or her address, he or she shall notify the Police Department within 10 days of the old and new addresses and the license number of each bicycle owned by him or her. § 3-2.1506. Serial numbers.

No bicycle retailer shall sell a new bicycle unless such bicycle has permanently stamped or cast on its frame a serial number unique to the particular bicycle of the manufacturer. Serial numbers shall be stamped or cast in the head of the frame, either side of the seat down the post tube, or the bottom sprocket bracket.

§ 3-2.1507. Information to purchasers.

Each bicycle retailer shall supply to each purchaser a record of the following information: the name and address of the retailer and the year, make, and serial number of the bicycle. (§ 1, Ord. 649, eff. September 24, 1987)

§ 3-2.1508. Reports by bicycle retailers.

Each bicycle retailer shall furnish a report to the Police Department within 10 days after the end of each calendar month as to all licenses issued and shall account for all funds collected. Each such retailer at the same time shall furnish information regarding each bicycle sold, but not licensed, including all information furnished for licensed bicycles. (§ 1, Ord. 649, eff. § 3-2.1509. Reports by used bicycle retailers.

Each person engaged in the business of purchasing or acquiring used bicycles, in addition to all the other requirements of this article, shall furnish a monthly report to the Police Department as to each used bicycle so acquired, including the name and address of the person from whom it was acquired, the consideration for the acquisition, and all other obtainable information required for licensing the bicycle.

  • (a) It shall be unlawful for any person to tamper with, destroy, mutilate, or alter any registration certificate issued pursuant to the provisions of this article.

  • (b) It shall be unlawful for any person to remove, destroy, mutilate, or in any way alter or tamper with any bicycle license issued pursuant to the provisions of this article.

  • (c) It shall be unlawful for any person to remove, alter, or mutilate the serial number of any bicycle frame licensed pursuant to the provisions of this article.

Article 16 Operation of Bicycles

§ 3-2.1601. State authority.

Pursuant to Sections 21200 and 21206 of the Vehicle Code, every person operating a bicycle upon any street or upon any bicycle route established pursuant to this article shall be subject to all of the provisions of the Vehicle Code applicable to the drivers of vehicles, except those provisions which by their very nature can have no applicability. § 3-2.1602. Bicycle routes.

  • (a) Pursuant to Section 21207 of the Vehicle Code, the Council may establish by resolution bicycle routes and/or lanes on any street or sidewalk or on any other facility provided for such use, other than a State highway.

  • (b) Any bicycle route so established on any street or sidewalk shall be marked and identified in accordance with the provisions of Section 21207 of the Vehicle Code.

  • (c) Any bicycle route so established on any facility created solely for the use of bicycles and pedestrians may be marked and identified as needed to assist and direct the use thereof.

§ 3-2.1603. Operation on sidewalks.

Pursuant to Sections 21206 and 21663 of the Vehicle Code, no person shall operate or ride a bicycle on any sidewalk which is not a part of a designated bicycle route established pursuant to this article and properly marked and identified in accordance with the provisions pertaining thereto.

§ 3-2.1604. Yield of right-of-way.

On any facility designated to be jointly used by both pedestrians and bicycles, the operator of any bicycle shall yield the right-of-way to any pedestrian. (§ 1, Ord. 649, eff. September 24, 1987)

§ 3-2.1605. Parking bicycles.

  • (a) No person shall park a bicycle upon a street or against a building in such a manner so as to obstruct pedestrian, bicycle, or motor vehicle traffic.

  • (b) No person shall leave a bicycle lying on its side on any sidewalk or park a bicycle on a sidewalk in a position which does not leave an adequate path for pedestrian traffic.

  • (c) Notwithstanding subsections (a) and (b) of this section, no person shall park a bicycle at any location which has been posted with signs prohibiting such parking.

§ 3-2.1701. State authority.

Except as provided in this article, pedestrian rights and duties shall be as set forth in Chapter 5 of Division 11 of the Vehicle Code.

§ 3-2.1702. Crosswalks.

  • (a) The Director of Public Works may establish and maintain painted crosswalks only as provided for in this section.

  • (b) No mid-block crosswalk shall be established without the recommendation of a qualified traffic engineer. Such crosswalks created prior to August 25, 1987, are hereby approved pursuant to Section 21106 of the Vehicle Code.

  • (c) Painted crosswalks shall not be established at intersections unless such crosswalks are require to clarify the safest crossing route for pedestrians. Such crosswalks created prior to August 25, 1987, are hereby approved.

  • (a) No person shall ride a bicycle, in any manner operate a scooter, coaster, toy vehicle, skateboard, roller skates or inline skates on, along, or over any public street, sidewalk, right-of-way or other public property of the City where the City Council has prohibited the same by resolution.

  • (b) The prohibition set forth in this section shall not apply until notice has been provided in accordance with this section.

    • (1) Notices shall be provided in and about the area where the activity is to be prohibited. Notices shall be placed in locations and in sufficient numbers so that they are reasonably likely to be seen by those engaging in the prohibited activities. Notice may be stenciled directly onto the sidewalk or other paved surface. Also, notice may be provided by the posting of signs.

    • (2) The notice shall provide in capital letters at least two inches high which activities are prohibited, and underneath shall provide in print at least one inch high "O.M.C. Sec. 3-2.1703."

No person shall in any manner operate a scooter, coaster, toy vehicle, skateboard, roller skates or inline skates on any public street, sidewalk, right-of-way or other public property of the City after dark; provided, however, that the provisions of this section shall not apply to the operation

and/or use of skateboards, roller skates or inline skates at a City operated skateboard park as defined in Section 3-7.01 of this Code so long as such operation and/or use is in compliance with applicable rules and regulations for such skateboard park.

No person shall ride a bicycle, in any manner operate a scooter, coaster, toy vehicle, skateboard, roller skates or inline skates on any public street, sidewalk, right-of-way or other public property of the City in such a manner as to violate the right-of-way of any vehicle or pedestrian.   • (a) No person shall ride a bicycle or in any manner operate a scooter, coaster, toy vehicle, skateboard, roller skates or inline skates on, along or over any privately-owned property in the City where the owner or owner's representative has prohibited the same.

  • (b) The prohibition set forth in this section shall not apply until notice has been provided in accordance with this section.

    • (1) The owner or owners' representative shall notify the City Chief of Police, in writing, of the prohibition and agree to post notice as required by the Chief of Police.

    • (2) Notices shall be provided in and about the area where the activity is to be prohibited. Notices shall be placed in locations and in numbers so that they are reasonably likely to be seen by those engaging in the prohibited activities. Notice may be stenciled directly onto the sidewalk or other paved surface. Also, notice may be provided by the posting of signs.

    • (3) Each notice shall provide in capital letters at least two inches high which activities are prohibited, and underneath shall provide in print at least one inch high "O.M.C. Sec. 3-2.1706."

  • (c) For the purposes of this section, "private property" shall be deemed to include property owned by other public agencies within the City.

§ 3-2.1707. Exceptions.

Sections 3-2.1703, 3-2.1705 and 3-2.1706 shall not apply to:

  • (a) A motorized wheelchair while it is being utilized for transportation by a physically handicapped person;

  • (b) A bicycle ridden upon a public street or roadway; or

  • (c) Vehicles operated in connection with a permitted parade or other special event where the otherwise prohibited activities have been expressly permitted by the City in a specific area.

No person shall ride a bicycle, in any manner operate a scooter, coaster, toy vehicle, skateboard, roller skates or inline skates in wilful or wanton disregard for the safety of persons or property. (§ 1, Ord. 711, eff. March 14, 1996)

§ 3-2.1709. Violation: infraction.

Violation of any provision of this chapter shall be deemed an infraction and shall be punishable as provided by Title 1, Chapter 2, Section 1-2.03 of this Code. (§ 1, Ord. 711, eff. March 14, 1996)
