§ 10-10

This chapter shall apply to all development in the City within the boundaries of an adopted Specific Plan, except:

• (a) The replacement, alteration, repair, demolition or maintenance of buildings or structures;

• (b) The construction, erection or use of accessory buildings or structures to a principal residential use;

• (c) Additions to or expansions of existing principal uses, provided that such additions or expansions do not add dwelling units nor for non-residential uses involve the construction or erection of a separate structure and further provided that such addition or expansion does not exceed, in square footage, 25% of the existing principal commercial use or structure.

For purposes of Title 10, Chapter 10 (Specific Plan Fees), development shall mean and include tentative, final or parcel map approval; site plan approval; rezoning; conditional use permit; planned development; and building permit issuance.

In the case of development requiring multiple development approvals, the Specific Plan fee requirement shall be applicable only once, to any particular property; provided, however, that if any development approval lapses and is not extended by the city and a development approval application must be refiled, a supplemental Specific Plan fee may be imposed by the City. Petitions for exceptions to the application of this chapter shall be made in accordance with procedures to be established by resolution of the City Council. Any application for an exception shall, at a minimum, specify the subject property, the development approval being sought, and the reasons for the exception, including any relevant supporting documentation. Article 2

Imposition, Calculation, Collection and Use of Specific Plan Fees

Specific Plan shall be imposed as a condition of development approval in accordance with the applicable schedule attached hereto and adopted by resolution of the City Council. No development shall be approved in the City within a Specific Plan boundary unless the provisions of this chapter have been fulfilled.

Specific Plan fees shall be calculated and collected for all development in accordance with the applicable Specific Plan fee schedule attached hereto, and adopted by resolution of the City Council, and as may be amended from time to time. Specific Plan fees shall be collected at the following time: upon the filing by the applicant for development approval of a development application which triggers the applicability of the California Environmental Quality Act of 1970 (CEQA), whether such development application is ultimately determined to require an environmental impact report, a Negative Declaration or is determined to be exempt from CEQA review.

Specific plan fees are intended to reimburse the City for costs associated with the preparation, adoption and administration of the Specific Plan, including costs incurred pursuant to CEQA. Therefore, all Specific Plan fees collected, unless otherwise designated, shall be placed in the City's general fund for general City use.
