Sec. 29A.20. - Discarding refuse or waste matter within harbor area; closing toilet…

(a) It shall be unlawful for a person to throw, discard, deposit or leave, either from out of any vessel or from the shore, wharf or otherwise, any refuse, sewage or waste matter of any description upon or into the waters of the harbor; and no person shall discharge or deposit material of any kind in any place or on the banks, walls, sidewalk or beach of any waters within the boundaries of the harbor area where the same shall be liable to be washed into the harbor either by ordinary or high tides, or by storms, floods or otherwise.

(b) It shall be unlawful for a person to operate, maintain, possess, keep or place in the harbor at any time any vessel equipped with a toilet fixture or fixtures unless the valve or valves on discharge lines therefrom are fully closed.

Sec. 29A.21. - Accrual of waste matter or garbage; owner liable for expense of removal.

It shall be unlawful for any person to allow materials, garbage, refuse, timber or waste matter of any description to remain on or upon the shorelines or docks of the harbor. The administrative officer may remove materials, garbage, refuse, timber or waste matter. Expense of removing same shall be stated by the administrative officer and shall be a charge against the party responsible for the deposit of the same and may be recovered by the directors of the harbor district from the party responsible for such deposit in any court of competent jurisdiction.

Sec. 29A.22. - Administrative officer to inspect plumbing facilities; approval.

Upon the application of a person or persons operating, maintaining or possessing a vessel or vessels that are using harbor facilities, the administrative officer, or his designee, shall inspect the devices attached to toilet fixtures. If the devices are approved and acceptable and in proper working order, the administrative officer shall approve the application, condition approval on repair or modification or require overboard discharge be locked shut and tagged "Do No Operate" within three (3) miles of shore.

Sec. 29A.23. - Depositing coal or petroleum products in harbor.

It shall be unlawful for a person to discharge or deposit or pass in or into the waters of the harbor any coal, tar, refuse or residuary products of coal, petroleum, asphalt, bitumen or other carbonaceous material or substance.

Sec. 29A.24. - Leaving dead animals, fish or putrefying matter in harbor area.

It shall be unlawful for a person to place or leave dead animals, fish, shellfish, bait or other putrefying matter on or along the sea walls, harbor structures, floats, piers, sidewalks or beaches of the harbor, throw or deposit such material in the waters of such area.

Sec. 29A.25. - Cleaning fish or digging holes in harbor area.

It shall be unlawful for a person to clean fish on the sea walls, harbor structures, floats, piers, sidewalks, beaches or water in the harbor or dig holes in or along the beaches of the harbor.

Sec. 29A.26. - Live-aboard permit required; vacation/hotel pass exception; revocation…

(a) It shall be unlawful to live aboard a vessel moored in the harbor without a permit.

(b) Slip renters may stay aboard their vessels without live aboard permits to the extent allowed by the harbor board as indicated in subsection (c).

(c) Terms, conditions and rates for said permit and vacation/hotel passes shall be set by resolution of the harbor board.

(d) Violation of this section shall be cause for revocation of the slip permit.
